Iam a residential subcontractor. I was hired by a GC to reside, reroof & install new soffit and fascia on a residential property in cloquet mn. I never received a down a payment and I never filed a intent to lien notice to the gc or the home owner. The project was started on Nov 20th 2020. The last day I worked was jan 26th and at that point the project was 99% completed. The home was inspected by the city building inspector and passed. We ran short on a few materials to finish the job 100% and they were a couple weeks out after ordering them. So I submitted an invoice for $14,000 roughly to the general contractor only for the work that was completed. The contractor then tells me that he will not be paying until the project is completed. But tells me that the homeowner and himself do not want me on the property till after they can meet on Feb 4th to see how they wanna proceed with the project because there are some quality of work being disputed. (Mind you the city building inspector already passed the work as it was done to meet mn building code) also feb 4th just so happened to be 45 buisness days from the first day work was furnished. So I didn't realize that till afterwards and now they meet and are saying that there is only $3800.00 roughly of undisputed work that they are willing to pay me and want me to sign a lien release form apon paying me. What are my options? ...Read More

I'm being told a story and I can't understand how she thinks she can save the house. If I'm being told the truth, she claims she has 2 foreclosures. One is from her company they used their house as collateral. She says they called in loan. She also claims she is in foreclosure on her personal mortgage. From my understanding she owes 55 thousands on the mortgage and the business loan was a half a million. She is in forbearance. She says she's is getting it until March wich my understanding is it ends December all home covid programs end. We live in long Island NY. So how is this house savable and also it will be left to her only child . Won't her get the lien debt if the house is willed to him? Please help me know the truth as it affects my life in unimaginable ways. Thank you....Read More

A disabled neighbor of ours found out we were selling our house in Onondaga County NY. The short story is, he put a lien on the house claiming he worked on it. He never wrote what he did (which somehow the County clerks ignored), so it's hard to enforce the 'you need a license for that work'. The lien amazingly enough, for a guy in a wheelchair who used to visit us for attention, lifts to the grocery store etc.. is $10,000, I kid you not. He's not a contractor, he can't get out of his wheelchair, but the county 'sustained his right to file the fake lien'. We know about bonding the lien. But that holds up our resources at the end of the sale for a whole year. WHO in this county can we reach out to? The clerks who took the fake lien, even the lawyer for the clerks office were all no help at all.. EVEN though they know the man (he's an alcoholic). Even though he didn['t fill out the lien correctly (It's a mess.. he never said what work he did, and 2x he put his own name where the lien asks 'who did you do the work for). (PS.. He is not a contractor, and filed this without a license. (how is that possible?) he lives on Social security, who may want to know about his 'earnings'. We did call the police, and will have a police report in a day or so, because when this man was drunk, he let slip that he's done this before. He may be a serial extortionist for all we know. Maybe he gets a $1,000 or so, just so people can get him off their back, and out of their closings... What can we do?...Read More

Hello, I am a homeowner who had a leaky pipe repaired. The plumber said it would be a simple straight forward repair. All he had to do was solder in new copper water pipes and replace a section that pin holed. He struggled with it all day and into the night. He never gave me a price for the job or his hourly rate. I was assuming a simple cut out and solder in would be about $300-$400 (another plumber told me afterwards it wouldn't have been more than $300. The plumber ended up not being able to solder the joints in the open section of wall and put in shark bite fittings which I could have done myself. He is now charging me $1405.00 for the repair and threatening to put a lien on my home. Where am I with this?...Read More

I am a general contractor half way through a addition and remodel the home owner decided I was to expensive. She took over paying the final bills to the last of the subcontractors I had brought in. She told me she would find another to finish the job. She will not pay me for the remainder of the window replacement. She is now saying she is not pleased with the work that one of the subcontractor did. But she paid him directly from her and not through me. She says she is not going to pay because she has paid me already and wants a hole list of stuff redone. Do I have legal grounds to file a lien and possibly take her to court over her not paying....Read More
