I am a project manager. I was hired to find a gc, all subs and all supplies for basement remodeling. Client decided to not pay anything above what I paid out and we lost 20,000.00 that we were really planning on when we got nixed from the job. On a deadline of a baby due date we busted our tails to complete on time. The drywaller that was hired through another gc on the project (framer) , was paid in full and decided to go to the homeowner and say he was not. He ransomed the job for almost a month. So to be done in time,, we hired our team to go in a knock it out with us.. We bought all supplies and half way through he shows up. He talked bad about all of our work (that was not complete!!!) and the homeowner listened to him and not me. Not sure why. He told him that it all needed to come down, drywall and all. (He hung the drywall btw) HO heard he could finish faster and not only paid him AGAIN, but paid him 5000.00 to tear out everything we did. It only needed to be sanded and thats all he did.. He never removed anything! HO said he'd take care of it, and we could go. Mind blown. I think my only option is to file a lein to be reimbersed. Is that correct? I put in 3 months of work on this job. We did everything. We hired electrician, plumber, hvac, bathroom, carpet (which I canceled) framer, insulation and GC. I applied for and obtained permits, and met inspectors, with GC and was there for every thing that needed to be done. My team was there, my company was very much responsible for the successfully completed jobs. We need to pay the people who werent paid in the process. Also is there anyone who take payment out of what we win? We have lost everything. Thank you...Read More

We did work on a customers home, her insurance company was a nightmare and she was little help. We took her to civil court which got the insurance company to finally pay the bill. The insurance paid the home owner not us, the customer is now refusing to pay us. She has admitted she has been paid and is not refusing to communicate .. In California once a lien is filed on a property I have 90 days "after" recording the lien to file an action. So I have read it on several legal & law sites. It is my understanding that the day has 24 hours, typically counted midnight to midnight. It is also my understanding that "after" in the English language means, after that day of the filing and thus aforementioned day is not included. Otherwise it would not, could not be 90 days. It would be only 89 days. As a fictitious example: if I register a lien at 3:55 PM at the recorder's office there's nothing thereafter I can do on that day as all government offices close at 4 PM. If hypothetically there would be a government office that operates 24/7 and I record the lien at 11:55 p.m. I would effectively have only 89 days and 5 minutes. A lien was recorded at the recorder's office on August 1, 2018 (no time stamp). An action was filed, after the fruitless settlement offers, on October 31, 2018 10:51 AM My action was filed and deemed [suspiciously] on the 91st day after a few month long fruitless attempts to settle and work out the payment issues with the client. Also, between August 1 and October 31 is at least one official government high holiday; Labor Day. Everywhere else and everything else I looked up in this state or other states it appears that government holidays do not count as well as counting begins after the filing day for obvious rational and correct reasons. I had my basement finished in 2018. The main contractor sub contracted tile work in the new bathroom. He did not pay the sub so the sub put a mechanics lien on my property (I had know idea that was possible). The main told me back in 2018 that he was taking care of it and blamed the sub yada yada. I now am in the process of selling my house and notice this is still recorded. The company with the lien is no longer in business and I don't know how to get in touch with him. I had a contractor work on my kitchen remodel. Start date was suppose to be on 17th of May with an end date two weeks. They completed some work and then he didn't show up for 3 days within those two weeks. I took a day off from work for him to complete some electrical work and he didn't show up. My counter top was delayed for a week due to poor measurements of the cabinet spacing. There is noticeable unsatisfactory work done on the kitchen. I had to hire someone else to do the work as he backed out of the job and didn't want to show up as I had requested. I then stopped the payment of 1900 due to loss of time due to paying another person to finish the work. What should I do now as he is threatening me with a foreclosure on my house. I had an air conditioning repair made. Two years ago, the HVAC company gave me an oral bid of $1200 to replace the AC coil and recharge the unit.
