I filed a lien on a job in Palm Desert, Ca and they are saying it is invalid because it was recorded after the 90 days. I filed the lien within the 90 days, but did not record until after. Is the 90 days calculated to the time of filing or the time its recorded? The completion date of the project that they have on the letter is also invalid. How do I get this corrected? I am a condo owner in Boca Raton,Fl. I hired Structuremode as the GC on my remodel. He initially told me it would take 6 weeks but there was often no one at my place.By June (Covid not withstanding he was maybe 80% finished (although I was unaware at the time of the corners cut and that he was not paying his subs) Although the contract states that the money be distributed in 3 payments , he was continually asking for more money when not one thing was complete.It also states that they would clean up everyday which never happened and I constantly asked for but it was never done. This resulted in my brand new floors being damaged, the new drywall was cut open in several places that did not need it by the electrician because he was angry for not being paid. I had to redo all that drywall! He also ripped open the duct work causing me to replace it and cut wires and left them hanging.The painting was horrendous and to be redone. On June 6th, although I had just given him an additional $3000 that was NOT due, he accused me of being in Breach of contract by trying to pay his subs behind his back. Why would I even do that if I just paid him? So he took off and at that point I did not even know the extent of his damages. Its cost me over $8000 to repair,replace and or completely redo his work.I have extensive documentation including emails and date stamped photos as proof. He has now filed a lien of Foreclosure for the amount I am claiming.This is completely fraudulent. He also has filed to move to a higher court with his counterclaim for the exact amount of my lawsuit. I realize that he is adept and has experience in fleecing people before. He has an additional case pending for $150,000 in damages. I have spoken with the party involved & they say the exact m.o. In addition Kyle Gardner id listed as the (Owner of Structuremode but he is operating under his father's GC license. His Father, who has never been at my property and I had no dealings with prior to his breach of contract accusation, brought the lien and counter suit and is signed by him. Is that legal? My initial mediation at small claims is on August 5th 2020 in Palm Beach County civil court. Do I need to amend my claim to include the lien? I need help! & I'm seeking representation....Read More

I am a General Contractor and we did a project for a customer. We collected payments as the project progressed. When it came to the final payment the customer is refusing to pay. I am in the process of filing a mechanics lien and the notice of intent will be sent in the next few days. If no payment, I will proceed with the lien but in Colorado the lien is only good for 6 months so you must proceed with a foreclosure process within that 6 month period. A lien was placed on my home when a contractor failed to pay the supplier - Humphrey's Lumber - the $40,000 owed for materials purchased to do a renovation on my home. The contractor WAS paid - by me - over $160,000 at the point at which the lien was issued. Clearly, he COULD HAVE / SHOULD HAVE paid Humphrey's - but refused. I was not aware they had not been paid (about 9 months in to the project). The contractor walked off the job. It has now been nearly seven years - and although we have tried to work with Humphreys (everyone knows who the "bad guy" is here.... as this contractor refused to pay Humphrey's in the past, resulting in an additional lien being placed on his mother's home....) Humphrey's Lumber is NOT (so far) willing to release the lien. The contractor is bankrupt. What is my next best course of action? I am willing to hire a lawyer. The contractor also stole materials from my job to build another house in Tiverton. Sub contractors were well aware of this action.
