Hello, I am a NC licensed General Contractor. It is a very long story but I have a client that owes me approx $9,000.00 for work we completed sometime in early 2019 and billed on 7-1-19. A lien was placed on my home when a contractor failed to pay the supplier - Humphrey's Lumber - the $40,000 owed for materials purchased to do a renovation on my home. The contractor WAS paid - by me - over $160,000 at the point at which the lien was issued. Clearly, he COULD HAVE / SHOULD HAVE paid Humphrey's - but refused. I was not aware they had not been paid (about 9 months in to the project). The contractor walked off the job. It has now been nearly seven years - and although we have tried to work with Humphreys (everyone knows who the "bad guy" is here.... as this contractor refused to pay Humphrey's in the past, resulting in an additional lien being placed on his mother's home....) Humphrey's Lumber is NOT (so far) willing to release the lien. The contractor is bankrupt. What is my next best course of action? I am willing to hire a lawyer. The contractor also stole materials from my job to build another house in Tiverton. Sub contractors were well aware of this action. Thank you in advance for your assistance and thoughts. I purchased a new home here in Georgia 1.5 years ago. The developer did not pay several of the subcontractors, and most all of those early liens have since expired or will soon expire. However, I just received a new grading/landscaper lien for work he had done in he past, before I bought my home. He recently came back to install a rain sensor (at the request of our neighborhood landscaping committee) that he "forgot" to install when the home was new, and is now using that as a basis to claim lien rights to 4000.00 dollars worth of grading/landscaping work dating back to before I bought the home. However, in the lien he states that he was requested to install the sensor to "add to or upgrade" the irrigation system (I guess he didn't want to admit he had forgotten back when the house was new), and not that he was "finishing" a job. This contradicts his email response from him stating that it was all one job, and that is why he can do this. Do I have a case to dismiss? Thank you!...Read More

Hi, in October 2019, my company provided specialty piping materials to a customer in Houston that were fabricated and pressure tested at their facility by our personnel, then shipped to their projects in New Mexico and North Dakota and applied to their customer's projects in weeks/months that followed. They haven't paid and didn't cooperate with us on providing details about their projects, site locations, owners etc. 2 questions: 1. Do we qualify to file a lien on both states based on my explanation? 2. If we do qualify, is there any possibility we can request an exception on timeliness due to their refusal to keep us in the loop on details? We still don't know exactly when the materials were applied to the sites, just best guess. Thanks...Read More

1. We are a Subcontractor and work under a GC. Our contract states that we are 'paid when paid' by GC from owner within 10 days. Trying to figure out if there is a proper time to file the intent to lien or the actual lien. My house was damaged in a hail storm last summer. A general contractor came to my door soliciting the repairs, before the insurance had been here to assess. We had already contacted another contractor and was on the fence about who to hire. This contractor said he would work the deductible into the quote/bid, which is the reason we decided to use them. There were numerous repairs, including new roof, paint, windows resealed, replacing patio canopy. They did the roof and then said they did not want to finish the rest. Told me to get other contractors to finish. I did have other contractors come bid and there is not even close to the amount needed to have other contractors finish the repairs after giving them what they say I owe for the roof. He denies telling me they would absorb the deductible. I have two witnesses who were present when he made the statement. We have been going back and forth for a year now. All I wanted them to do was to complete the repairs they agreed to do. They refuse. I sent them the written bids from other contractors. Of course, they put a lien on the property.
