I filed a mechanics lien on a property. It has been more than 90 days since filing the statement of account, but I didn't file to foreclose on the property. The owner is trying to sell and is now threatening to sue for "slander of title" and unfair or deceptive trade practices and threatening damages. What can I do? Can I still get my money? We filed a mechanic's lien, a law firm sent a letter to dismiss the lien and the letter refers to "reserving all claims against JDM, it's principals, agents and others responsible for the lien filing". I noticed poor work being done by sub-contractors, numerous inspection failures, theft and even attempts to generate fraudulent income from my insurance company. Before signing over my 2nd draw from the insurance money, I was advised that the contractor may bail upon receipt. I asked for a couple days instead of just signing over the large amount of money. In response, the General Contractor changed locks and screwed doors and windows shut, forcing me to kick my door in to be able to enter my home that night. They failed the 50% completion inspection required for the 2nd draw payment. I requested a list of materials used and work completed to date and instead of providing this, the subs were pulled off the project and he immediately filed a lien on my home. Due to the holdup, the plumbing contractor sent me his invoice to try to collect. His invoice is 3x the cost approved by my adjuster and full of fraudulent charges as well as no mention of the copper pipe he unnecessarily cut out and stole from my home. I also paid $10,000 for a kitchen upgrade from my own money and he has failed to even acknowledge receipt of this despite proof of deposit into his account. That's the basic gist of the situation minus further questionable behavior by the contractors and subs. I was told I had to provide a right to repair and they have 30 days to respond, but I'm nearing my deadline where I will lose $44,000 depreciation money if construction is not completed. Also possibly important is the contract states that payment is to be made to a different company than the one performing the work and the company does not have an active business license. I filed a six-digit Mechanics Lien for nonpayment of architectural services. We have an AIA contract in place. As a result of filing the lien, I received a letter from an ambulance chaser attorney threatening to sue me for filing the lien. I called the debt collector people you recommend and gave them all the documentation. They called the lien holder to collect and the lien holder lawyered up again, scaring the debt collectors that I’d hired and leaving me unprotected and alone. The lien holder hasn’t filed any lawsuits against me, but has proceeded with construction by bonding off the six-digit lien. The six month deadline is in 4 weeks. What do I do? I need a construction litigation attorney on contingency, as this former client basically put me out of business by basically stealing over $100,000 from me and I have no $$$. I have also developed severe PTSD after dealing with this nightmare client and putting up with his abuse and nonpayment of my services afterwards, effectively putting me out of business and provoking the layoff of the people whose only fault was working on his plans. In 2017, $32,530 fraudulent lien filed. Now that we have proof, verified by contractor, that his costs were $134,000 and we paid $147,000 he is claiming it is lost profits and overhead. Attorney has charged us almost $60,000 and we are headed to trial. The complaint is unverified, but Lis pendens was filed. Attorney has refused to file motions and wants to take it to trial. A shoddy contractor improperly poured a concrete floor in my basement. He will not supply me with the delivery ticket although it is obviously to wet a pour. Concrete splashed up the wall and onto the ceiling and cracked like shattered glass. This $4000 job will cost me $17000 to repair. I have paid for two inspection (home and engineer) reports saying poor planning and poor execution. I've shown pictures to forty contractors, all say not acceptable. ACI and Portland Concrete will not get involved in residential but agree not acceptable (off the record). His insurance company is refusing to pay without inspecting. Concrete supplier has instructed staff not to talk to me and will not allow quality control person to inspect. This shoddy contractor has filed a mechanics lien on me with false dates to meet deadline requirement. I have had three lawyer consults, all say good case but economics are bad. I am a small heating and cooling contractor in Athens Ohio. I got tied into doing business with a guy installing furnaces and ac’s. I sent an invoice on August 29th 2019 and I have not received a payment on it. He has repeatedly given me dates and time and time again he hasn’t paid the balance. My husband worked as a sub subcontractor. He did not get paid for the work that was given and was fired for stating that he will finish the job but then go his separate way. Was not allowed back on site to finish up work and now is being sued for uncompleted work, plus being sued for fraud on taking out an attempt to lien and breach of contract.
