I have ongoing projects going at my boss' home. We would like to cut ties with the current contractor but he refuses to sign progress made waivers for the first three draws that he has received full payment for. He says that he won't sign anything until payment for two other draws is received. Those two draws are for materials that has not been received, work that we specifically did not approve and on site supervision that was not done (we have a log of who is in the residence and how long). A contractor roofer did not complete 95% of contracted work on our 1,600 sf residential rehab property. The 10% he work he did complete was wrong, not to code and unsafe. He never filed a Notice of Commencement. He admitted poor workmanship in conversation during our home inspection in front inspector as witness. Our contract for 21K for a metal roof included existing shingle tear-off, which he did. He installed felt, sloppy, with insufficient spacing and qty of nails, failing county code inspection. He repaired a small truss incorrectly, not to code and unsafe, per our home inspector. We fired him (and hired a qualified roofer who saw the shoddy work, and completed all work to code). We offered him $1,200 ($60sq labor) for shingle tear-off, some 2x4's & felt (which we had to rebuy new). He told us to fly a kite and sent an invoice for over $5,000. It included labor he didn't do and an $1,100 dumpster he never provided (they used our dumpster). He then filed a lien for over $5,000. We learned after he has numerous similar complaints around town with other clients. He also cost us 2 1/2 month production delay (worth approximately $2,600 at cost we'll never get back). Q: CAN A FL OWNER CONTEST A LIEN WITH 20 DAYS (OR LESS) FOR CLAIMANT TO RESPOND INSTEAD OF 60 DAYS? Q: CAN ANY OF THE ABOVE SOMEHOW RESULT IN VOIDING HIS LIEN? Good morning, my question is my mortgage company sold my home when I was in modification And I filed bankruptcy and supposedly saved it by 11 minutes, but Found our i didn’t need to because I was in modification which I knew I was even though they kept saying they never got any paperwork which I faxed five times with confirmations and they still sold it.. But “supposedly” they didn’t record it even though the guy that bought my home illegally showed up at my front doorstep the next morning of the auction with the contract signed and everything, Also they mail me papers showing that the title went back to the bank.But it’s like it erased into thin air and then made an offer to us before we said anything Which is very much guilty do I still have a case? Also I had a flood in my house and it was never finished I still have holes in my walls, water underneath my linoleum, Half of the carpet gone and more. So my second question is can I file for a mechanic lien even though I am in foreclosure and I’m Suing my Morgage Company at the same time As I put it up on the market to sell it on Monday Yeah my lawyer is telling me that I need to put it on MSN ASAP and I don’t know if that to hold the mortgage company back give him more time which I believe so since I have tons of equity Do you want my house bad and there’s a lot of mistakes that They made which are illegal. But I’d like to get more for the house by getting all the stuff done, Plus I had PG&E which is My power company come out to do an assessment Because I have been really sick and on disability and it’s a free program where they’re going to fix everything including weatherize the windows, doors stuff like that.. I know this is a lot you guys, but I appreciate the honesty and help as this past year and a half has been absolute hell divorce cheating wife Home sold illegal. So do you think this is possible?? We won a judgement in chancery court against our builder : Breach of contract & negligence the chancellor ordered judgement amount of $125,343. We also have a court hearing today, to file our attorney costs, discretionary and all other misc costs. Our judgement for the breach of contract & negligence order was signed off by the chancellor on 23 December 2019. It’s now, March 6, 2020. How much time is a Defendant given to pay a judgement and is it paid to the court of paid directly to the Plantiff? What if the builder REFUSES to pay? Is that considered Contempt of Court?? Hello, a subcontractor of mine is suing me in small claims court as he was never paid by my contractor for part of my bill. I never had a legal agreement with the subcontractor as the subcontractor was hired by my contractor. Do I have personal liability in small claims court in this scenario for a debt unpaid to the subcontractor. I thought the subcontractor had to file a lien on my property to recover his debt. Is that true? If I go to small claims court and tell the judge that I had no agreement with this subcontractor and he didn't pursue a mechanics lien will my case in small claims court be dismissed?
