I had a repair shop look over my trailer to do some work to it to rebuild and repaint it. We agreed on items and a budget. Then shop owner kept changing things we agreed on without notifying me; different countertop, paint, flooring, exterior is done in house paint and auto paint and not the design or colors agreed upon. On top of this I emailed shop owner 4 separate times a month ago asking him to only do work on the inside and to wait on the outside; he had not yet started exterior work. Emails went unanswered. Shop owner now threatens to file lien on trailer. Owner yells at me on phone a week ago and screams for me to take trailer, keep my money if I think another shop can do it better. Owner now denies it but admits via email he lost his cool on the phone with me. Owner has admitted "so what, who cares" attitude when I inquire about things that have or have not been done. I have all emails documented. I want my trailer back but it will cost at least 3k to get the exterior fixed plus inside was not completed either; left patches of paint in areas, wrong countertop, wrong flooring etc....Read More

Hello, I built a home in 2016 with a builder and the house started to leak prior to the close. The builder has attempted to remediate the issue multiple times . The drywall above my kitchen sink collapsed in this morning and the builder is not will to speak to me about this. They stated that my home warranty has expired and they are not responsible. The builder attempted to repair the leak before and after the home warranty exited. Are they responsible for the work and the damage? Thank you!!!...Read More

Our customer asked us to file since our intent didn't work. He requested we file a lien to help push for payment. They have now paid us in full since the Mechanic's Lien did not work to push for payment. Now that our customer has paid us in full and we were running out of our lien rights, the ninety days has expired from filing the lien. My customer doesn't want us to do a Release of Lien since they still have not been paid, but don't we by law have to do a release of lien since we did not file suit after the 90 days of filing the Mechanic's Lien?...Read More

I am a Registered LLC. Residential Construction Sub Contractor in the State of Florida. I also have current General Liability Insurance. I entered an agreement with a relative of a very good customer of mine to do a remodel. My intent when I wrote the agreement was to Have a Licensed General Contractor that I know generate a Formal Contract, Take the job over, Pull Permits where required, and I would Sub Contract the scope of work that was in legal bounds for my LLC. from the Licensed GC. My customer did not want to incur the costs of bringing a Licensed GC in, nor did the customer want to pay the cost of Permits. I made a very bad decision based on this individual being related too a very good customer of mine, and entered agreement to do the job myself, without Permits. After receiving a Deposit, and Second Draw, I spent the following 7 months remodeling this customers Condo while the customer added numerous extras, several change orders and was the source of several distractions resulting in additional time. 3 days before completion of the entire job, I emailed him a change order invoice for $3500.00 with resuming work being conditional upon his payment of the Invoice for just a few of many Change Orders and Extras he had requested verbally, and Approved verbally via phone from Virginia prior to permanently relocating to Florida. He refused payment of the invoice and stated that he had not authorized ANY Change Orders, or Extras, and had no paperwork indicating such, he also informed that because I was not a Licensed Contractor that legally, he did not have to pay me, and I had no recourse. At the time of the dispute, their was roughly $1500 in work remaining which I could have completed in 3 days. Upon completion, his final invoice would have been roughly $16,000.00 plus the $3500.00 he refused to pay. I informed him that In the event, I wasn't paid up to the current phase of completion within 5 days, I would turn over documentation to the presiding Building Department that would result in a Stop Work Order for No Permits, which in turn would likely require him to vacate until the Stop Work Order were resolved, with the possibility of being fined daily, then having to hire a Licensed GC to pull retro Permits at 5x the original Fee, and very likely requiring destructive exploratory Demo to evaluate compliance, with all being at his expense. So regardless of what penalties came my way for not being properly licensed, he would incur costs that would be substantial, easily amounting in 10s of thousands of dollars. He immediately had an Attorney send me a Form Letter, NOT a Complaint, stating that their client denies approval of any extras, or Change Orders, That I represented myself as a Licensed Contractor, That he had no idea regarding Permits, That he incurred $4000.00 in hotel bills, rental car bills, and storage bills, because I failed to meet the projected completion date, That i was in Breach due to the projected completion date, All of which are lies that I can easily disprove via documentation I have in my possession. I responded to the Attorneys Form Letter truthfully and accurately, without incriminating myself, but also letting them know, I had documentation to disprove their clients false claims, and was only looking to be compensated fairly for work performed, no more, no less. I also stated that their client clearly received an impeccable remodel, was not claiming, any damages for shoddy workmanship, defects, or anything related to Quality of Workmanship, or Materials, his $4000.00 in expenses were incurred during a month long stay in Florida he made by choice, knowing his condo would not be completed, and while his primary residence in Virginia was undisturbed, and available to him the entire time he was in Florida. In closing I let the Attorneys know that their clients refusal to pay the change order invoice, and the timing of the refusal of payment to nearly any Judge, or Attorney would be interpreted as a textbook example of customer whos intent is, and has been non payment of the final balance due. I am a subcontractor, finished a job didn’t get paid put a lien on the property they bonded I file a claim with the insurance company that have the surety (who they choose for the bond) they rejected it saying the owner didn’t have a contract with me but with who hired me. I am an electrical subcontractor who is in a contract with a GC. We have many issues with the GC and they are not paying us or our change orders. I am a home owner who hired a construction company to come in and landscape my backyard with pavers and artificial grass. Two weeks after the job was finished, I noticed that the artificial grass was failing. Also, weeds were growing when they should not be. I contacted the construction company who did the work and was informed that their warranty only covered the "hardscape" of the pavers and not the artificial grass. After a long protracted ordeal I was able to get the grass manufacturer to send me a new piece of turf, but they would not install it. The turf was shipped to the contractor, without my knowledge. I then contracted the contractor and asked them to install the grass under warranty, they refused but said they would give me a "good price" for the install. I then attempted to get assistance through the loan company, they could not do anything. I then went to the construction companies insurance company, who offered me $500 to settle, I said no. I now want to go to the bonding company and open a suit against the contractors bond. The work was done in Nov of 2018. Can I sue a surety company and the contractor in small claims or does it have to happen in Superior Court. If I win, is the insurance company or the bonding company compelled to pay me? Years ago I sued a person in small claims court that hit my car and was able to send the judgement to their insurance company and they promptly paid me, I am hoping the same could happen here. I have contracts and pictures to prove they installed incorrectly as well as a video of another installer pointing out all the things they did wrong. ...Read More

Greetings, I am a small contractor based in NY City. I was working on a big project for a client based in Ny City. We completed 80 % of the work. I was paid 15 % of the total contract in 09/19. I requested for another 45 % of payment in 02/20. I reached out to the client last week, 03/23/20 to get an update on the payment status. I was informed that due to Covid 19 all the operations has been closed and they are not sure when will they be able to make payment.
