I was working a residential bathroom remodel, the contract was for 22627.01, including tile cost when selected and with change orders and additional work, verified through emails and verbal change orders the total became 27752.78, I was paid intermittently total of 13000. when it came to 1 more day of work to just knock out a very small punchlist, the night before I asked for 10000 and allowed him to hold a retainer of 4752.78 until the next day when i completed the job and he was happy. He denied the 10000, wrote a check for 2000. then the next day, I was told that I was not allowed back to the property and that my workmanship was unsatisfactory. Then he offered 2900 only if i signed a letter of dissolution. Hes now threatening to file fraud with L and I. all the supposed poor workmanship was the things I had on my punchlist, The bathroom is absolutely beautiful, Ive showed pictures to alot of people and everyone agrees that its a great bathroom and the amount of work I put into it is close to 300 hours. Throughout the process, there was never a single complaint and his wife even said multiple times that with my work skill and knowledge of processes and supplies I should have my own improvement show or broadcast on youtube. But the day before it was time to settle up, my work all of a sudden was unsatisfactory. pictures are up on my website. www.waunatile.com under a.d.a. compliant remodel. this guy owes me almost 13000 and all my prices are completely justified, hes making up prices for my business, what do I do, I have 400 to my name as all I had went into this project....Read More

I have a customer that I have filed several liens on in the past. They have bonded around every single one of them so I sent a demand letter to the bonding company about 2 weeks ago. I have not contacted them yet. I figured Id give them this week and them start calling. but my question is, is if I cant get anywhere with them what is my next step to get paid? file suit? this over several different states....Read More

We had projects with the same client, but 4 different LLC's. They are not paying. We completed 2 large projects. 1 had just some finishing to do, they agreed to let another finish up. and the last one went sour. They sent a stop notice to us, really because the owner and the Project manager/owner couldn't get along. But then hired our main subcontractor, who was running the job for us. I am an HVAC subcontractor that has multiple past-due invoices from the same contractor. Five are for single-payment contracts that are within the small claims limit. One contract has two progressive payments with one invoice within the limit and one above the limit. The combined total is 20K. With the 2% penalty applied the total is closer to 30K. I did not complete the prelims in time, so I plan to file the cases. My questions are: 1. Which would be a better approach, individual small claims cases or a combined civil case? 2. I did for some work for a contractor out of Castle Rock,Co., but the job location was in Watford City, ND. He sent me home for the holidays and was supposed to have called me back when job was ready to start back, but never did. I found out that he bought in another crew to finish my work. My contracted work amount was just over $100,000 and he only paid me about 15k of that amount. I am a sub-contractor, we did not receive payment on completion of a project. I sent an intent to lien, recorded the lien against the home owner. I received a letter from the home owner's attorney that the lien was not valid due to being past the time frame allowed. Hi, we have 2 separate invoices for same apartment building in Hawthorne, CA. The owner approved work and we completed most of it. She hasn't paid a dime. We stopped work and are asking for payment after she refused to comply with city code. One invoice is under $10,000 and the other is too. However, if you combine them, it comes to $13,500. Can I file in small claims? Sue the same person with 2 claims? Or is there a different way I need to file?...Read More

During a time when I was having to make near daily trips to an area nearby, Rosemary Ami, hired me to wrap, pack, and stack, items left by her deceased sister Katherine Price, at 1090 Buckskin Dr., Show Low, Az.,85901. She was paying me $15 per hour. Gave me the keys, and packing materials, and told me to keep track of my time, this was in Nov. 2018. She also mentioned at that time she needed to get someone in there as she realized that just to spend an hour or so wasn't making the job go as quickly as needed. I'd had to repair a number of things just to make the place liveable. I then moved into the site to get things done quicker. That was March 1, 2019. In mid April,2019, I gave her a copy of my hours, which both the original and the copy had been signed by her. Come May,2019, I'd asked her when she thought she might be able to start paying me. That's when she exclaimed "I haven't any money!" At which point she decided to get herself out of paying me, she'd start charging me rent. Her keys were returned to her the end of May,2019. I told her I'd moved out as she was to be paying me for the work done. A judgement was obtained 11-14-19, in which the total awarded is: $3,500.00 plus 5.75% per annum. Rosemary didn't start paying anything until Feb.,2020. These amounts were only $40.00 per month. I text sent her a receipt and balance due which included the 5.75%. After making the second two month payment, she stated that if I continued to charge her interest, she'd not make another payment. The March and April payment wasn't made until May. Interest again applied. She then stated she'd not make another payment. Rosemary Ami is collecting Soc.Sec. and is a licensed massage therapist, having two locations she gives treatments: Snowflake, and Holbrook, as well as in peoples homes. She is yet paying on a mortgage on the home she lives in: 8476 Pueblo Ln., Snowflake, Az.,85937. She and I believe her brother were left the: 1090 Buckskin Dr., Show Low, Az.,85901,address. She also owns a mobile home in a trailer park, in Holbrook, Az. On the Show Low parcel, being said there are several liens. She's supposedly a man there, doing work on a place that hasn't an updated septic system. It only had a what seemed to be a barrel with a 2" pipe coming out of the top. Which was spewing sewage every time the toilet was flushed. I've photos of what I was asked by Rosemary to be cleaning up. I had to spend weeks cleaning the place, just to put a bed in it. Homeowners who started addition to main home early fall of last year. Few issues in the beginning, but most recently found wet/ moldy insulation under sub floor. Our electrician and plumber opened up two small sections of floor to install wires/ plumbing. First hole had very wet/ moist insulation. Second hole had fiberglass insulation that we could squeeze out the water. We approached the topic with our General Contractor and he said he would "investigate " but it would cost us his time and we would have to pay for any new insulation that might be needed. Us not knowing anything about this topic reached out to town building inspector who said that is is the General Contractors responsibility to investigate and repair. Well it's been weeks now since he has opened up the floor, multiple areas with mold. All the insulation has been removed, still in the process of cleaning up mold areas. Our General Contractor has not listened to our concern or really even cared about the mold. He is trying to rush and finish this job and its clearly showing. We have spent many hours on our own getting out insulation that he "didnt see" or thought he could get away without removing it. We have pointed out several areas of mold and he clearly thinks we are wrong and it's not mold. Building inspector agrees its very clearly mold. I have lost all trust in our General Contractor. He is supposed to be installing new Fiberglass insulation by the end of this week or early next week. I have lost many hours of sleep and worry he isn't doing things properly. I feel the need to clean up the mold after he does cause I haven't actually visualized him doing it. I spent many nights on my hands and knees getting out insulation. It's exhausting, I want to continue on with this addition but the way he has spoken to my husband and I is so unprofessional. I don't trust that he is doing the best for my family. I want to feel 100% certain that we won't have issues down the road with mold or anything else. The thought of a lawsuit sounds exhausting, someone also mentioned something about calling the state and reporting his General contractor license. Few more issues with him but this was the big one.
