I am a contractor in iowa working as a sub for a Texas company. We had a contract for $43k at start of project just to get started while waiting on final prints for civil work. We completed contracted work and started excavation per verbal agreement to get change order, first payment date came without change order so I sent invoice for contract price plus $24k for additional work, got paid no questions asked. Got prints and continued excavation, building pads, and rock work per their print. Was told we could get new contract or change order for additional work but never happened. Next payment dat we came and sent invoice for work additional $232k. 30 day no payment so I reached out and got told project manager had resigned and they had no idea what work I had done, the did have a site supervisor on site full time that reported in writing with photos every day worked with exception of a few weekends or late nights. Sent them invoices for trucking involved to move dirt, tickets for rock delivered to site, work that had been completed to there prints. Still refuse to pay, tried offering $100k to settle with me which I refused. I have a debt collector attorney lined up to place a lein, I first reached out to a litigation attorney and he referred me to debt collector because he says there just trying to get out of a debt. The company has told me the only budgeted $100k for civil work on project which isn't even feasible for the amount of work to do per there print. After growing a successful GC business from $0 to $15M over the last 5 years, me and my partner are now starting anew with our own company, Carbon Zero Buildings. We develop design and install multitrade energy and water upgrades like heat pumps, boilers solar, etc. Our customers are owners and operators of large multifamily properties. Our typical project size is $150,000, but ranges from $20,000 to $2M. We would like to start our business with a solid prime contract template that works for our business and our customers. And we will need the same for our subcontractor agreements, too. Can we get by with using standard templates like AIA or ConcensusDocs? Or LegalZoom or RocketLawyer? Or would we be better off hiring a lawyer to provide us with a custom template who understands the nuances of California law and/or multifamily real estate? We are on a start up budget but willing to make the investment if necessary. Any advice would be greatly appreciated....Read More

I am a flooring company that installed, sanded and coated a 3,000 sq ft house. New construction, first contract was for install, second was for sanding and finishing the wood. I was paid full for first and only half for second contract. Work is completed, and homeowners want more finished coats. They were told once they pay the rest of contract I will then buy more poly and do how ever many coats they want. Not putting any more of my own money into a job that I haven't been paid for. (When theres been many issues with money along the way. ) My question is, If I put a lien on the house/owners does that stop them from being able to move in until I am paid fully for completed contract? I was hired on a public project to replace the metal roof under a contract from my company to the township of summit county ohio board members. It was a parts and service building next to a police station that we agreed on a certain amount. I also put about 2000 extra dollars into the project. Long story short they swindled me and ended up not paying anything on 7700 dollar invoice. this was completed in June of 2020 and shortly after during my attempts to get paid I came down with covid and it kind of mixed everything I had going up. What can a homeowner do when a contractor lies about being a certified installer of fiber cement board siding and did such a poor job the manufacturer states the poor installation voids the 30-year warranty? We also ask for a particular siding manufacturer, and without talking with us he decided to go with a different manufacturer, even though the manufacturer we requested was written into the contract. The same contractor hired a painting company and their work was so poor the paint manufacturer also will not grant us the warranty. In both cases, the contractor only warranties his work for a year. He also refuses to correct any problems because in his opinion he did the jobs correctly. He also tried to write a new contract and gave us only 48 hours to make our decision. My contractor was paid entirely under his contract for work performed. His contract did not include gas line work for my construction project and we needed to hire a subcontractor for that, the original contractor said he had someone that he uses and verbally quoted us for that job. The work was preformed and completed and then he invoiced us $600 more than the quote, when questioned he stated the amounts were justified and valid. They actually were uncharged on his end for the service of contacting the sun-contractor. As it also happened he, (original contractor) had two issues that had not been resolved from the end of his completion of work. We refused to pay anything else until all was resolved, he finally the original contractor came back almost 3 months later to try to fix/correct issues. He then filed a mechanics lien against us, as he had not been paid for the gas line work. He also used the last day of labor as the day he came to correct the original issues in which had nothing to do with the gas work performed. My question is: would this put him outside of the 60 days to file as the job was invoiced and completed (gas line) and a separate issue from the original work that needed corrective issues completed, in which he still had not completed? ...Read More

There are multiple issues with this project and due to health conditions the bonding company that took over the original contract is pulling of the job. They are releasing us as the sub contractor. We are currently building a multifamily building in Southern California that is 2 stories of wood frame over concrete foundation and podium. We have engaged with a General Contractor to subcontract the frame and concrete work at the project. For the sake of clarity lets call this GC as GC 1. GC 1 has engaged with another company to perform the concrete and frame work, later on we found out that the company that GC 1 has engaged with also holds a General B license, which makes the company a general contractor. So lets call this company GC 2. So GC 1 has contracted GC 2 to perform the work and GC 2 has used its employees in its payroll to perform the work. GC 2 does not hold a C5 or C8 license. Does this mean that the company GC1 hired as a subcontractor (which is GC 2), does not have the proper licensing since they executed the job as a subcontract? The crew that GC 2 would pour concrete and then the same crew would switch their tools and work as framers. The quality of the work has caused problems such as problems with drywall not being level, windows not being level, water leak through concrete, additional stucco work to cover the concrete that was not properly formed are just a couple that comes to my mind. What is the best way to recoup some of the damages that were caused by GC 2 due to performing a trade without C5 or C8 license? And what kind of action can we take against the GC1 which has subcontracted this work to GC 2 knowing that the only license they have was a General B License?...Read More
