I hired a GC to build my house. There were many problems on the job. His 1st change orders were very complete. Then he began to stop ALL work if change orders were not paid in full in advance. The change orders now contained the item and amount. Like interior barn doors $6,000 ( cost Breakdown) increased by $1,438.89 to $7,438.89. I reminded him that we changed the contract to included those doors. He agreed, but I went a head paid the change order. He had me verify the doors were correct. They were. Later he sent me a new change order for the interior doors. On it he refunded the $7,438.89 and now he charged $17,565.83. The only changes to the original was 2 doors changed from 3 panel glass to 4 that he said were $39 per door more and Knotty Alder trim that should only cost $2,000 and 1 door changed from a barn door to a swing door because they way it was framed, would not allow a barn door to be used. These items were not mentioned on the change order. Only Knotty Alder Door, case, window case except living room and bedrooms and the $17,565.83. I would like to see the invoice. I price everything and could not come close. How can I get a copy of what I paid for. The door company when I asked said they could not give me a copy and I understood. I asked if they could at least tell me the number of doors. He started counting framed door opening and stopped. The reason is because I had no framed openings. I believe that some DOT Officials and a Construction Firm and the company hired to inspect the work all collude to embellish the legitimate change orders and add some items that should not even be a part of the change order. How can I add the dates for progress payments if I don't know how long it will be until we get the necessary permits to begin work? I entered into a strange relationship with a general contractor who from my perspective was trying to give his construction business design-build capability. It started as create some construction documents and we will see how it goes. No contract, no hard figures as far as payment goes except for $1 per Sq ft (excluding the non-livable space). As time passes and projects were completed I kept getting wiffs of something and it started feeling like something was off. I was in the process of making some changes to some documents when I received a request for a cheaper alternative method of construction (specifically changing from a stem wall with spread footing to a slab on grade monolithic style foundation) my immediate reaction was HELL NO. I didn't respond immediately, the request was on a Friday evening. The next day I asked 1 of the 3 home owners had signed their contract yet. They had, on Friday morning. From my perspective, he is trying to save money by cutting corners without the owners knowledge. They believe that they are paying for one type of foundation, yet would more than likely receive the cheaper alternative were I to supply it. I adjusted my invoice and send a formal letter stating that due to my elevated exposure to risk my invoice would reflect that. I am a Sub Contractor working for a company that is NOT the GC. ( so I would assume they are sub contractors aswell). I did not file a notice to owner when starting this project in Mississippi back in June 2020. I have a feeling do to payments dragging the company I am providing labor for only is not going to pay me for work completed( we are at number 95% right now). Can I still sent a notice to owner ( I only know the GC on this project not sure how to find out the owner)? I also have change order which I still need to submit after completing that beginning of Sept 2020. And last I am still owed retainer which normally only gets released 45- 90 days after completing my scope of work which will be done by End Sept 2020 First week Oct 2020. As a note. I am a subcontractor who worked on a 64 unit apartment building. Our bid cost did not include some work that was listed on the architectural drawings (it was inadvertently omitted). During the job, the GC realized that the work was not included in our bid, so we submitted the change orders and we were paid. The job is now over, the owner filed a Notice of Completion, and the GC is now stating that we were not entitled to the money because this work was included on the drawings and according to the contract, we should have included the work on our bid because it was on the drawings.
