Hello. A builder built a home next door and changed the grade in Saint Louis County, Missouri. There was several damages done to our property due to this change. We are in a lawsuit, and cannot find where to go to get help. The swale was removed and changed the direction of the water that affected our property and the natural water flow. Who would you suggest we get help from? Army Corp of Engineers, Sewer District, as we got zero help from our county. We started a project on a fireplace but the project was held up for permitting. The customer lives in a city that was very difficult to even get the permit. We are finally completed with the project and find that the fireplace has increased in price by over a $1000.00 since we started. Do we have to eat that as the GC or can we bill the customer? They have paid 50%. We have completed framing and outside of the home repair. Everything is done except for insert which was a change order. The original project was a full kitchen and family room remodel. Which is 100% complete and passed final inspections.

Not a situation yet. I'm a plumbing contractor and work in small towns in the county. In all of my years in business, I can't remember filing the proper paperwork to cover myself in case of nonpayment. Most deals are sealed with a hand shake or a signature on the proposal. Things are changing in the area and I have had a couple of close calls, as far as payments are concerned. Not really familiar with the proper order or specific documents I'm supposed to file. I'm a subcontractor that finished a job and did extra work as the general contractor asked us to do. It was mostly trade damage, they never approved our pay after we already did the extra work for them. We have a GC that will deduct back charges / and or deductive changes from our invoice without any sort of notice. Every time this happens I get notified by our controller which in turn I asked the GC for the backup. So far every back charge or deductive change is completely invalid and I've disputed each one.
