I am about to sell a property which has a mechanical lien. Because of Covid, the litigation has been suspended. We have not received a new court date yet. The reason there is a mechanics lien is due to me sewing the cement company who quit in the middle of the job and I sued them. They, in turn, put a mechanics lien on my property. I am a land owner who has leased several tracts of land to construction companies. The construction companies are allowed to hire contractors to perform work, erect buildings etc...on the property. Although my contracts say that the construction companies are not to allow liens to be put on the property, sometimes their slow pay process, does cause contractors to place mechanics liens against them, and on the property that I own. I want to avoid allowing liens on the property that I own by my Lessee and the way that they conduct business. If I require the construction company to obtain a payment bond prior to the work being performed, can I require a lien waiver or subordinate the lien somehow to the Payment Bond?...Read More

We filed a Sworn Statement of Amount Due in Louisiana and infomed the owner. The GC told the owner that he bonded off our claim. I'm not sure what that means, but he said it voided our lien and he would be able to get a clear title form the courthouse. I filed a lien in Flordia and I got a notice that the lien was bonded on May 6, 2020. After looking at your resources I read that I would have to file a suit within one year of bonding a lien. What other steps can I take? Should I contact the person the bond was transferred to? Is there another document I can send through Levelset for this bond? The clerk of court WILL NOT TELL ME what form I need to file to have my money released back to me since the notice of contest has expired and the lien claimant has done nothing. We are a supplier on a private ( i think so anyways!) project in NYC. The GC is not wanting to pay, claiming we did not fulfill our obligation. Our position is we did. We filed a lien; the notice went out yesterday. The GC also emailed us yesterday stating they were "set up to bond the lien". I read the explanation of what that means, but I don't know the nuances of it, and what the next steps are. If they previously applied for a bond ,will that make a difference for our claim? how would we have known that, if they did? are they required to advise us? I am doing an FHA equity loan and have 3 credit card liens on my property, . 2 with Discover and 1 with FIA. I have an attorney negotiating for lowering and paying off these debts with my loan monies. We are ready to close but need negotiated letters of amounts to settle for. These 3 debts have been renewed. The Discover debts were renewed after 7 years in 2019. The FIA debt was renewed 3 years ago which makes that debt over 10 years. We have finally heard from FIA with a lowered number which we may tune up a little but seem to be getting the run around with Discover. They all know that if I do not get a decent negotiated settlement that I would file for a chapter 7 bankruptcy to relieve all debt and have a clear title to my home. What do you think is holding up the Discover lawyers? Its like take 50 or 60 % or get nothing down the road. Question, what can be done to get something done? There was a deadline to meet which has passed to close the loan at 3.75%. I have to do an extension that will will cost me $2,000 at closing to keep my 3.75% loan rate.
