I am a private individual that remodels homes. My handyman hired a plumbimg company to perform plumbing services. However the company did not perform the work. Their crew only showed up for 2 days, started the work and then never returned. We completed the work ourselves. In June I recieved a notice from a lawyer that a lien has been filed on my home. In communicating with the lawyer, I has provided fradulatent invoices indicating all the work was done by the plumbing company. Previous to recieving this lien I had not recieved any invoices. At this point I believe the plumbing company missed their deadlines to file a lien, and created fake invoices to try and indicate they were within the timeline to file a lien. Should I challenge the lawyer back directly, or do I need to hire a lawer and counter-sue? Addiitonally, I have a closing slated in 2 weeks, and am concerend this will mess up my closing. Home Owner We are acting as a general on out home in Colo. We hired a electrical contactor. His bid was 15,000.00 I paid him a deposit of 8500.00. He know seeks another additional 3300.00 for the deposit which was not declared in his proposal stating that I needed to give in a total 11800.00. Also, he has billed us for work that was in his bid and has over charged us for time and material indicating that we owe him another 6,000.00. We have been trying to resolve the issue and he is unwilling to do so. He has filed a Lien on our property. How do we resolve this issuse . We are trying to sell our house. Four days prior to closing a lien was discovered on the property. It was filed by Conn's Appliance corp. in 2011. We never were notified about it. After Talking with their billing office it appears the debt and lien were sold off to a collection agency around 2015. The company that purchased the lien/ Debt has since gone out of business. I am the owner of a development of condos. We are one the first building of 5 buildings. We hired a contractor (RUSTIC) that was in over his head, wasn't paying attention to quality, and was submitting bad invoices (we paid him for items we never got like carpet, hot water heaters, etc and numerous invoices were doctored or just bogus). We fired him. Rustic submitted a final invoice for approx $17,000. We hired an attorney for a possible lawsuit for shoddy work we had to re-do and his bogus charges. After Rustic received a letter stating we wanted approx $150,000 returned for all of above, Rustic said they were checking their accounting to make sure there were not more charges. They then filed a bogus lien for $253,000. Our legal options are to file suit or turn him into the Attorney General of Idaho. We have been advised both are options as we have alot of proof for the contractors actions. BUT, we need to sell the condos, thus have the lien taken off. What kind of bond and approx cost? A trash box provider (hauling for broken concrete) is threatening to place a lien on my property, claiming that they haven't been paid for their service, despite our contractor paying and the provider having already taken the trash box (would not have taken the box if they haven't been paid). They claimed that there was cardboard boxes in the trash, and that there was an additional charge since cardboard is not allowed in the box. Our contractor agreed to pay and asked for a receipt from the dump site for charges so that he can reimburse. The provider refused to provide and decided escalate to a mechanic's lien. We reached out to try to find out what's going on but they refuse to talk to the owner (both via phone call and by certified mail). The only tripping point we have is that my contractor failed to receive a receipt for payment, but as mentioned before the provider would not have taken the trash box without payment for their service.
