We are an equipment rental company. We initiated a lien on a real property where we provided rental equipment. However,currently the amount owed was more than the lien amount. We are currently within the 90 days as of the last day of the delivery of the services. However, the general contractor posted a bond couple weeks ago, which is also less than what was owed. Can we amend our lien to reflect the correct owed amount, even though there is a bond? The Florida statutes FS 713.08 and 713.24 seemed to be contradicting as to amendment of the lien amount. Is there any risk of not able collect any or portion of the amount owed in case of amendment to lien? Thank you for your help!...Read More

My GC bonded off a lien so now our closing in mid Sep will move forward. He says my company is compketely removed from the lien now and he will fight it in the courts. Sorry this is going to be long! We are a supplier to a general contactor for a project in Nevada. This is one of our best customers we've been doing business with over 30 years. We supplied a canopy from a vendor in Texas and when it arrived at the jobsite is wasn't fabricate to match the construction drawings supplied to them by us. The general contactor had to hire a local company to modify the canopy so that it could be installed properly. The send us payment minus the backcharge for labor. We in turned paid our supplier minus the backcharge. Our supplier didn't agree and has filed a lien on the property. We did not or plan on filing a lien on this project. We informed the GC about the lien and they requested that we bond off the claim. I'm not sure we can do that as a supplier. We have never had to supply a payment bond before so how would be bond off a claim. If I am reading your website correctly only the GC or Owner can bond off a claim. Is that correct? ...Read More

We are a millwork sub in Texas who still have approximatly 8k due on a job that is completed. Third month notices will be due on 9/15. We received communications from a firm that says that the GC is filing bankruptcy and that 17 of our fellow subs are hiring them to collect their money. If this is true and the GC files bankruptcy, does that change the owner's obligation to pay off any lien we file? I am doing currently a job for my builder. I am wiring a new 4 unit town homes in Denver, Colorado. I pulled an electrical permits for all 4 units. I finished roughing in and pass my electrical inspection. My builder or also an owner decided to make a major changing to raising the ceiling in the kitchen and dining area. He hired a demo crew without even telling me. The he rewired all the kitchen and dining room area. When I last got there the drywall is already textured and paint. I am seeing a lot of mistakes, mis wired, basically a few electrical lights and outlets won't work. The ceiling will need to be tear out again to fish the wires again. I keep telling my builder or an owner he says that he can do whatever he wants. He told me not to show up on the site at all. My contract says I will get paid after full rough in 50 % . And I will get paid 50 % after the trim pass inspection. So I am afraid that i will not get paid at all. I told him I will file a mechanics lien he says that he will buy the bond out. So he doesn't care at all what I do. So I don't know what to do whom to call. I have spent a lot of money to rough in the building. All my profits is on the trim side. Help me please. We are an LLC that has done Basic Landscape Maintenance and more, weekly for a commercial client for over 2 years. When they owed us for services rendered for June, we notified them that we weren't going to go back to maintain the commercial property until we were paid to date. We did receive the late June payment but at the same time, we were told that they no longer needed our services and we were fired. We sent a Termination of Services Letter to them that clearly states that they still owe us for 2 wks of our services and that it would be due and owing until it's been paid. We've also sent an invoice to them 3 times; to no avail... no payment. The amount owed is $615.
