We paid a general contractor for some residential construction. It was to finish a basement. He started the work in March of 2021, but has not touched the project since then. He keeps coming up with all the excuses of why he can't finish. But basically, He spent our money on another project, instead. He refuses to give our money back and says he can't afford to pay his guys to come back and finish. I had to pay out of pocket to finish purchasing the rest of the supplies. So iModStructures.com went bankrupt on me while owing $89,xxx from work I had purchase order's from them to perform. Back in May 2021 they sent out a letter stating they did not have sufficient funds to remain operating, so I filed a claim on the bond for the project (CSUMA). In August 2021 after months of delaying things, the bond company sent a denial letter to EVERYONE who filed a claim on the bond. I know in CA the bond statutes are a lot more strict, I am suing them currently and feel like the bond company should be liable for all added incurred cost's. Anyone know more about this?...Read More

We are a supplier who provided material to a customer who was doing a job for a City in Tennessee. However, we never received payment from our customer because the owner of the job took our customer off the job at some point, but the job is still not finished and the owner cannot give us any detail on when the job will be finished. We filed on the bond through Levelset in August. When we finally got someone from the City to speak with us about the bond information we immediately filed claim with the bond company. However, we got a notification from Levelset this week saying that our deadline for filing suit to enforce the bond claim is due 12/3/21, which is tomorrow. Obviously the bond will not have paid out by tomorrow, and in the case that it doesn't pay out, can we not file suit against the customer and/or City in Tennessee for the amount due to us?...Read More
