Hello! We have affordable housing project in Connecticut, we are materials supplier, owner is non profit organization. Which project type in Levelset we should select for Affordable housing projects- can affordable housing projects be under "state/county" type? Our last delivery was 07/29/2021, and only retainage is left not paid. This project have a bond, so we could file bond claim. Could you please explain deadline for retainage bond claim, as we don't know when our client - general contractor applies for or receives retainage. I am a subcontractor who has worked on a non-public construction project in Iowa. My last day on site was 17 February 2022. I haven't received payment from the general contractor and I would like to make a claim under the Payment Bond (form A312). My questions are: - Is there a maximum period of 30 days to make such claim? - If there is, do the 30 days start counting from completion of the project as whole or from completion of the works which the subcontractor has performed? - Is the action therefore time-barred or am I still entitled to make the claim? - If I am entitled to make a claim, is there a specific form I should use? Our company fabricates exterior metal wall panels for Commercial/Residential/Federal/State buildings. Almost all of our costs are incurred prior to shipping the panels to our customers. We provide shop drawings and engineering services, order the materials for the panels, and fabrication labor all prior to delivery. Since the majority of the documents for lien rights are based off of shipping/delivery dates, we generally send the preliminary paperwork upon shipping. In this case, we have provided the service for the shop drawings and engineering (customer has paid for these services), and have ordered and received the materials for fabrication (customer has failed to pay for materials - received and invoiced in November 2022). No preliminary notice was sent, as no panels were delivered to the job site yet. The job site is in Scottsdale AZ, (Housing/Apartment Complex) Can we still lien? What options do we have prior to looking into a lawsuit?...Read More

A plantiff (General Contractor), sues another GC (GC 2).. then adds whoever he can find that can be associated with that person including every bond company who has ever issued a contractors bond to them. GC 2, hires the bond company a lawyer and is paying the fees to honor his indemnity agreement. the bond company wants out of the law suit so they decide to talk directly to the plantiff's attorney and negotiate a settlement of 15k. the bond company pays the 15, the plantiff dismisses the bond company but does not report the settlement to the judge.. the bond company does not notify the principle in any way. it takes about 3 months for GC2 to find out, which only happened because the CSLB suspends his license for not re paying a bond.. it takes another 5 months to get an invoice from the bond company with the amount owed. the court case proceeds and the plantiff's lawyer drops him, the plantiff files to dismiss all parties and closes the case to avoid trial. (it was a shake down from the start and GC2 wouldnt play the game and won because of it). does the surety have the right to collect even a penny? this seems very illegal and unethical...Read More

I followed the instructions from L&I’s website and filed a summons and complaint for breach of contract against a contractor who took a large deposit, disappeared for 6 months and will not respond or refund our money. After I filed the complaint and researching I realized I didn’t include all the required info on the complaint. For example, i did not include the GC’s middle name but is included on the L&I registration. I did not include his registration effective date or bond effective date. I also was did not include the details of the case, like why he owes us money, the contract we signed or exhibits such as copies of the checks he cashed or letters we sent terminating him. It has been more than 20 days. The GC has not responded but the bond company did file a notice of appearance and sent us a letter to us asking for details. Can I file an amended complaint to include the info I should have included in the first place?...Read More

I filed a complaint with the CSLB. The CSLB issued an order of correction to my former contractor totaling almost $12,000. The contractor has not paid and his bond insurer made an error processing my bond claim and now won't pay. I worked on a project for a GC with a subcontract agreement to subtract actual payroll costs from the subcontract during the progress of the work. The GC wrote in the subcontract that I would be compensated the remaining delta. They provided the materials. I provided the field sampling and laboratory testing via 3rd Party. The GC is unwilling to submit a significant change order for the benefit of the subcontractor due to his relationship with the owner. The outstanding change orders for unforeseen conditions, winter concrete protection, and filling voids in substrate exceed $50,000. The remaining balance of the subcontract also exceeds $50,000.
