Can I require payment up front for materials on my contract jobs? How do I protect myself in this environment where our economy is plummeting and I am still getting work? I am a Subcontractor and standard procedure is "we get paid after the G.C. gets paid" but we are supposed to buy all of the materials and furnish labor before we can invoice. I did a job for a residence that still owes me $3,000 for my services. They informed me they put my account in their Bankruptcy. I then filed a Notice of Intent to File a Mechanics Lien. Now I get a letter from their Bankruptcy Lawyer they have a hearing to remove the Lien from their property. Is this a bluff? I haven't filed a lien yet. Should I go ahead and file a lien? We have a large national restaurant chain customer with about $28,000 in unpaid invoices for work on many different facilities in about 15 different states. This customer filed CH 11 last week. Are we able to file liens for past due invoices on property owned by a third party landlord or will that be construed as an action to collect a debt and therefore not allowed due to the Chapter 11 filing. We are victims of the David James Homes fraud in Virginia. All our payments were to DJH we had no dealings with the subcontractors, did not hire them or sign contracts with them and have no idea who most of them are. We were never owing to DJH at any time in our contract with DJH and are, in fact, owed $42,000 by DJH for work we paid for not supplied. A subcontractor has put a lien against our property in the amount of $3,800. It is now past the 6 months deadline they have to enforce it. Additionally, it is for work we already paid DJH for (DJH had a very weird PREpay draw schedule, so we gave the money for counters to DJH 3 months before they were installed, DJH just never gave the money to the subs). Merle Heckman filed bankruptcy last fall with DJH. The case is ongoing. Because the 6 months has passed, can I petition my local county court to remove the lien or do I need to wait until some specified time after the DJH bankruptcy case closes? The "automatic stay" wording regarding bankruptcy was confusing and I don't want to petition to have a lien removed before the window for enforcement has closed....Read More

I had a house fire in 2016 - almost totalled. Hired a contractor to render the repairs (~$260K). After the time frame for the contract expired, repairs were still under 50% complete. Repairs were sub-quality including actual construction and materials. Disputed poor workmanship with contractor and they abandoned the project (ripping their builders box from the tree). Shortly afterward, they implemented a $50,000 mechanic's lien on the house and initiated a suit for $34,000. We hired an attorney and counter-sued. After depositions, meetings with our attorney, etc., we have piled up $22,000 in attorney's fees and haven't even gone to court. We can't pay the fees and our attorney stated they are filing to withdraw as our attorneys this Wednesday. I am meeting with a Bankruptcy attorney on Friday. My question is: Will a bankruptcy remove the mechanic's lien from my house and dismiss the law suit and the $22,000 attorney's fees? Thank you so much Chris Johnson...Read More
