My father was the sole owner of our company, now owned by myself and my 2 brothers. He signed a contract back in March of this year when we had plenty of employees to complete the work. The amount the project was bid for has drastically increased with the price inflation in the construction industry and the sub we had planned to sub the curb work out to has had to move on with commitments on other projects because this particular project keeps getting pushed by the owner from my understanding. My builder hired a substandard concrete contractor. They have been working on my home 6 months and foundation is still not finished. 1 to 3 workers show up for 1 to 3 hours , 1 to 3 days per week. They have left trash on lot the entire time, dumped another 2 - 3 tons. Removed most after I raised sand. Builder does not have any control of contractors. I've been met with months of delays. I have zero confidence in concrete contractor and now builder. There are several defects with the foundation that may be correct, but contractor hasn't made effort to correct. I am a steel subcontractor working on a public job in Alabama. I have two separate "contracts" for this job. A purchase order for the steel materials and a subcontract for the steel field erection services. The GC has had all kinds of problems on this job and is likely facing some liquidated damages. As such they are looking for every possible pocket to back charge including mine. No matter how false the claims, they are using a "throw it against the wall" approach and see what sticks. Yesterday the informed me they are holding payment until they can confirm or argue many of their so called "back charges" for delays. So, I would like to file liens to protect myself. (a) do I need to file separate liens for the PO and the subcontract? I would think I would? (b) I currently have billing that is 20 days past due and more coming due in about 15 days. I have completed a job for a GC which was slated to be completed by Feb of this year. Due to this they requested us to do multiple move ons, site visits and meetings over the course of several months. All during this time prices hyper inflated on materials which they said they were unaware of. Also during this delay other projects started and the majority of my man power was used on this. After months of calling they finally were ready. I was only able to provide two techs to the job and agreed for one week of suplemental labor provided by the GC at inflated costs. the end of that week I told them i would provide more man power and would not need their laborers. The GC still had laborers on site and are back charging me for changes out of my scope. I refused to sign the change order explaining that the following week I told them they were not needed. I also stated that the changes in the civil were not part of my scope. The owner of the GC is forcing me to sign and saying he is going to add other charges to this because I delayed his job. I will not talk to them on the phone anymore due to their erratic story changes and trying to keep it all docuemeneted on emails. This is not a large project- base contact is 35k and they are trying to deduct over 11k out of my contract and telling me more is to come. Do i even have a leg to stand on?...Read More

This is an unusual situation where I’ve done significant work on a property (my wife’s) under the understanding that it was our house even tho my name isn’t on it. Now she is claiming I have no right to it at all and is also claiming all mortgage paid prior to our marriage (almost 30k) be reimbursed upon the sale of the house before splitting the remainder after the mortgage is paid. We were together five years before she purchased the house in which she lived at my apartment rent free while finishing a degree which allowed her to get the lucrative job she now holds. I want to send an invoice for the work I’ve done conservatively estimated at 50-60k but didn’t invoice when originally doing the work because it was understood to be 50/50 ownership.
