I did not send the 43-11 Preliminary Notice and now it says Virginia's 150 Day Rule is due tomorrow. We don't have an attorney in VA. Will it be okay to not send that notice and wait to send the Post-Work 43-11 Notice in April 2022 when we are planning to be done on the job? How does the 150 day rule work when you don't know the last day you will be on a job? ...Read More

I signed a contract for an addition to be built on my house. Unfortunately my circumstances have changed and I no longer need the addition. The contractor was given an initial payment of 22, 400 at the signing of the contract. He has drawn up the plans and had them reviewed by an engineer to submit to the county. no materials have been bought nor has any work been done yet. I have offered the contractor to pay for his plans, time, and whatever time or money he laid out which cannot be more than a few thousand dollars. I have sent him an email spelling out my situation and have asked him to provide other work on the house for the initial 22k . I see no clauses in the contract regarding cancellation of the project and am not asking for a refund. I just dont need an addition anymore and am willing to allow the contractor to provide various other projects on my house so he will not have to provide a refund. Hello, We worked on a job in Virginia from 03/01/2021, and we delivered 6 containers, last one 05/20/2021. Client didn't pay for last container because of some issues, but was ordering small orders up till 10/07/2021. Client paid for small orders. We decided to Lien this project, because client is not paying debt from last container in May. Alter looking to Virginia Lien Laws, we saw that we can file a Lien for materials delivered within 150 days - that means our debt from May is not covered. We canceled last small order for client which one we had to deliver this month, so our last delivery date now is 10/07/2021 - if we would submit post work notice now, we are late by 15 days to do that. Could you please advice if we still have Lien rights even if we submit Post work notice now? And if we have Lien rights, can we file for amount owed from May? Please advice what should we do in this situation, as client said if we will file a Lien they will bond off that Lien ...Read More

Hello, I am managing a project and the contractor notified me that a specified material (in this case, "ISO" roofing insulation) is "unavailable". I expect a "Substitution for Cause" request to be forwarded. However, instead of offering a change order that reduces the contract sum, I am being told this will cost me another $100,000 or more. Is that valid, or should the contractor be responsible for the additional costs? In other words, who "eats" this extra cost - the contractor or the owner? Thanks, Kelsey Granville...Read More

I recently purchased windows from a company that part was credit and the other part cash. I am in Fairfax VA and the company has threatened a mechanics lien. The billing department statement show $7690 for the window and $4400 for doors to be installed at a later time. Total of $12,090. I got credit for $3600 on the windows and now the company is telling me I owe them $12,090 for windows. That is clearly incorrect. If I have the statement from the company that states what was performed and what they charged me. $7690 for removal and replacement of windows will I need an attorney to pay for their mistake as he claims. We are a Low Voltage Contractor for Hotels. We took on a job in Virginia which had delays and many redo's which we were not allowed to issue Change Order's for and 1-week before were supposed to be complete the GC removed us from project with an outstanding balance due to us of around $30k. We issued a property lien which got bonded off and now received a letter from the GC demanding we pay for their overruns of $70k because they switched contractors 1-week before the due date. The total project contract was $118k and they are claiming overruns of $100k, not quite sure how that is possible. ...Read More

Im a water damage mitigation contractor and have a solid contract for services rendered. The invoice is 99 days since issued. I believe they were issued a check by insurer for damages but only for 17,500. The homeowner recently refinanced their home and will not likely be selling or refinancing in the near future. Best way to get paid? I'm preparing a small claim (in my county the limit is $25,000) for the invoiced amount, $24,824. (includes late fees) and will be proceeding later this week....Read More
