I am trying to make a draw schedule to repair a home, that a tree had fallen into, last summer. She has gotten the Home insurance check but the mortgage co has to sign it also. They disburse the money, as the repair work is done. She already has the adjusters estimate. I have been in my newly built house for 2 years. I have had a problem with my furnace since day one. The home builder's HVAC sub-contractor has not been able to fix the problem after 4 visits. I have a background in HVAC and am convinced that this is a design problem that is going to cost the builder a significant amount of money and they don't want to pay to have it repaired. I think they are waiting for me to give up the effort of having them repair the system properly. What would my first step be to pursue legal action for resolution? Thanks, Mike...Read More

I sent the Notice of Intent per the date to do so from Levelset, however i received the below letter from our customers Attorney, what do we do? It is clear from reviewing the file as well your recorded lien that the lien is not valid. As you know, the memorandum needs to be filed within 90 days after the month in which the supplies are provided. In your case the lien would have needed to be recorded in 2021. As you mention below, the lien was recorded on 1/4/2022, which is beyond the deadline. We understand that --has sent this “lien” to contractors / owners / stakeholders on this job as an actual lien, which it is not. Given that does not have a lien, it is slandering the title of the property in question and tortiously interfering with my client’s contracts. We hereby demand that -- retract its statement that it has a valid lien and cease communicating with any party on this project regarding collections given that it has no claim against other stakeholders or ownership. In the event that my client suffers damages or my client’s contract is impacted by -- actions, we will seek indemnification from --for those damages. Please confirm by COB 1/13/2022. Hello! We worked on a project Dairy central Phase 2 in Virginia. Last delivery was 10/07/2021, we are not paid for deliveries from 05/20/2021, 09/27/2021 and 10/07/2021. On 12/02/2021 we filed a Lien on the property, last day covered according to 150 rule is 05/10/2021 so we should be covered. We also sent Preliminary notice to client and owner on 09/30/2021. Notice of intent to Lien to client on 10/25/2021 Post work Notice on 11/19/2021 to owners and client (we were late if deadline is 30 days after last delivery) Lien filed 12/02/2021 Today we find out, that probably our project address is not exactly correct, as Dairy central project is combined from few phases, and we worked on Phase 2. To the Lien we added 946 Grady street Ave, Charlottesville, VA 22903, but looks like Phase 2 building is located at 400 10th Street NW, Charlottesville, VA 220903. According to 946 Grady street Ave address Levelset added owner name - Dairy Central Phase 1 LLC, but looks like we should change this as well to Dairy Central Phase 2 LLC. On other documents we saw Stony Point Design Build as owner as well, so we listed two companies as owners on the Lien. Hello Experts, I was looking for guidance on my options. I am a sub contractor for a contracting company based out of VA, which moved to MD and the company was eventually sold to an owner who has declared bankruptcy. I am based out of MD and was performing work for a company based out of Milwaukee, WI. I have not been paid for my work performed in July and August. We have sent multiple reminders and the demand letter but no response. Our contract was signed by the CEO of company based out of Virginia. Although we were not made aware it seems that the company was sold and the new owners have filed a bankruptcy.
