Hello. A company is threatening to file a mechanics lien against my home. They were contracted through our home insurance provider. The home insurance representative has sent the company an email disputing their work, double charges on some items, and inaccurate measurements/charges. The company is not responding to the home insurance and is insisting that I pay the amount dictated or they will file the lien. Can they do this even though there are apparent errors/fraudulent charges in the bill they are asking me to pay?...Read More

My question is about licensing. We are a flooring company. We do not have a contractors license because when we apply for our business license we are not required to have one in Virginia because our contracting sales are not above $1000 per job or over $150,000 per year. We have two sections on our business license. One for retail sales and one for contracting. A job falls into retail sales if the labor is associated with the sale of materials. In that instance you don't need a contractors license. Will this prevent me from filing a lien?...Read More

I am a licensed HVAC installer and put in a system for a home which is closing Aug. 19. I was contracted by another contractor for the install which included the materials (which I paid for) and labor. I was supposed to receive payment upon completion by this contractor/Company however, he is not returning my calls neither to me or the owner of the property. The property owner told me to try and collect from the Company who sent me to do the job. I don't feel he will ever pay me as he is now not returning my calls. I am a 19 and there was a $4,000 lien put on my checking account. It is from a company that has no record of me buying anything from them (including name, bank info, and SSN) but they do have record of my mother. My mother had a lien put on her account first from them. My mom says she did not use any of my information to get the property and I believe her, but my problem is that I need it removed. Does it make sense for them to put liens on both of our accounts? I filed for an exemption. We talked with our client to try to get paid and that didn’t work. I sent a Notice of Intent to File a Lien, and they received it on 5/26. On 5/27 they sent me a message, “provide me with a waiver for this claim”. On 5/31 they sent me another message, “Dispute-not willing to pay”. Shortly after that message on the same day, I received another message that was really, really long! They explained why they weren’t willing to pay due to our subcontractors work, and that Charles should have overseen the project better. They believe that we owe them for the amount they already paid for the materials that they still have on their property.
