A supplier in Utah has placed a mechanics lien on my project in Idaho. The supplier was never contracted or contacted by our company (the General Contractor). A subcontractor ordered the material to be delivered to the job site and then never showed up, thus defaulted on their contract. Two questions: 1. What state's lien requirements take precedence -and- 2. The material was delivered to the site on July 1, 2021. It was the only delivery. The lien was filed on December 29, 2021. That is 182 days. In Idaho the limitations are 90 days...in Utah 90 days after Notice of Completion (does not exist since we never knew where the subcontractor ordered his materials from) or 180 days from work completion. It appears that the claimant has fudged the dates on the claim stating that the one delivery was dropped between August 2, 2021 and September 21, 2021. I do not know how one delivery could span a 51 day period. I imagine the date(s) were adjusted at an attempt to move the "work" into the allowable timeframe to file a lien....Read More

I am a material supplier and have three jobs within the State of Utah I am preparing to lien. We sold materials to a subcontractor. Much of the balance we are due from the sub contractor is for items that have become part a permanent part of the property (industrial coatings). A portion of the amount we are owed is for the purchase of equipment and tools needed to apply the industrial coatings purchased for the projects we are preparing to lien. I am a home owner who purchased a solar energy system from a door-to-door salesman. The salesman told us 3 specific things we would receive in the package deal that encouraged us to buy. We now find out that one of the things he promised is (according to the prime contractor) technically impossible to do, and also that the salesman was actually a sub-contractor to the solar installation company. The work performed was good, but is missing a last important element. The solar company has now cancelled their work arrangement with the salesman, and they say that they can't finish the project as promised by the salesman (though not contractually agreed to). I have the remaining 60% final payment to pay for the project, but am unwilling to do so until the project is completed as promised. The salesman has agreed that he did, in fact, promise the final element. My question: If the solar energy contractor puts a lien on my house, what are the consequences for me, and what are the chances that the contractor can petition to foreclose on my house, in order to obtain his $10K +/- remaining fees?...Read More

I have pre liens against my property, where payments have been made. I also have a lien against my home that I was never informed of. The person who filed that lien never supplied a bill and they did not complete the work - it did not pass inspection. The lien was put on the property 10 months after the work was done. I am a broker that arranged for a truck to pick up a load in Tremonton, UT and deliver to Norwalk, CA. The contractor owes us money for credits from materials he over bought and returned, mistake he made pouring concrete foundation, and gutters he took down, disposed of and never replaced.
