Owners file an insurance claim and have an attorney who just got them paid a settlement of 80k from our insurance company. The owners have not allowed us to retrieve >$5000 of our owned tools and equipment since telling us that we are "off the project until further notice" on February 2, 2021. This was immediately after having us quickly handle the immediatel work related to the water damage claim by way of us removing the wet drywall, drying/dehumidifying the areas damaged by water to the satisfaction of their newly added 3rd party inspector, and replacing and finishing the drywall. Hello, My grandparents had some work done to their home back in 1987, and some of that work noticeable as poor workmanship (long story) however my grandfather did not pay all the monies and a lien was placed on their home. the lien was sold to a third party and the lien was not enforced within the time frame in Texas I assume becuase nothing never happeded. They never went to court and my grandmother is still living in the home. Howver after the ice storm in Texas she need to get some work done to her home and now she cant because it shows that deed is listed under the 3rd party that bought the debt.Please help with a little insight on what we need to do after 34 yrs. We are a small engineering firm that does not perform construction work or installation of materials. We were contracted to provide materials in accordance with someone else's design, perform an instructional visit to the job site to train the contractor to install the materials correctly, and finally to provide acceptance testing and approval of their installation. In our proposal we have language that prohibits the with holding of retainage if we did not install the materials, but our client with held the money anyway. A friend, ask me to fix her mother's house, her mother doesn't speak English do her daughter is the one dealing with all the renovation. I prepared the proposal that it said ones you sign this proposal it became a contract. But the mother never signs the contract her daughter sends me a text saying to get the job going because she wants her mother back in the house and give us $18,000.00 down then another $2,750.00 (this is an insurance claim job) so when we done 80% of the work the daughter asks me for an invoice date a year old for $30,000 to send to the insurance company so she can get more money from the insurance, I refused to do that and told her that that will be fraud said got mad and remove the key from the key box and don't let us going in and finish the job. she claims the mother leave there but she has rental insurance NOT HOMEONERS INSURANCE. So, my question is, can I put a lien if she never signs the contract but give us the down payment and send a text that authorized us to do the job? ...Read More

My mom recently built a house. During the process, she repeatedly asked the contractor for invoices as well as an itemized list of all money used and what was left so she had an idea of where she could spend our not. He never gave any of that and went over budget by somewhere around 50k. She moved in and found that all the work had not been completed that she had asked for, as well as things did not work properly (ie. doors don't shut completely and water gets through.) She asked for these things to be taken care of and he assured her they all would. Then he comes back and says if she doesn't pay for the rest of the services , even though they aren't completed, that there would be a lien put on her house. She ended up paying even though not all things were completed and now has paid for services not rendered: -Door still leaks water when it rains -Cabinets not installed - Custom closet not done to agreement - Trim around doors uneven with walls - Not painted in certain areas He says she changed her mind too much so those are her issues too deal with.
