There is a building owner, a tenant and us (the GC). The building owner leased a space to the tenant, we built out the space for the tenant. The tenant did not pay. We asked Levelset to file the lien for us and they did. They filed a Constitutional Mechanics Lien, listing the property owner and the tenant. I am being told we cant lien the whole building since we did not have a contract with the owner but this is how they filed the lien. I have contacted Levelset about this and am getting nowhere. I have an attorney and he told me to contact them since they are the one who filed it. They are telling me to contact someone on this "Free Service" that can take up to 2-3 days for someone to get back to me. I don't really have 2-3 days as the property owner is trying to sell the building and has called contacted his lawyer to tell me to remove the invalid lien. We did a city job for a general contractor in October, November and December 2021 and never received payment for work that was done. We supplied a customer tanks and pumps, then we deliver diesel fuel into the tanks at their yard. The customers uses that diesel for their job sites. The diesel is consumed at the job sites not at the yard where the diesel is delivered to. The customer has past due invoices and have not paid. If we ask for a change that generates a change order, our contractor is charging his 15% on the cost of the job AND sales tax. If the job is 1000.00 and sales tax is 80 the contractor charges us his 15% on 1080. I understand we have to pay sales tax but it doesn't seem right that the contractor profits from sales tax that we are paying....Read More

I work for a GC & we have a Subcontractor Affidavit form; don't know where it came from, who created it or if it's a valid document we can use. We require the Subcontractor to provide a supplier list & traditional conditional/unconditional, progress/final waivers for both the Suppliers and Subcontractor. There are some cases where the supplier did not perform work for the month and refuse to sign $0 conditional waiver. This is where the affidavit comes in. It gives the Subcontractor the opportunity to bypass the supplier and sign the waiver themselves. There are also different versions of this form; (A) the supplier not been used for the month (B) the supplier needs to be taken off their list of suppliers because they have not & will not work on the project or (C) do not have any suppliers associated to this project. All of them state the following: project name, number, and address, Subcontractor name & type of work; we require that it be signed & notarized.
