I am a homeowner in Denton County Texas We had a water leak under the foundation that cam up and through the foundation into the house in a hallway. We have a 1,900 square foot home and a water mitigation company performed basic demo/remediation of the entire house flooring (tile and floating laminate), all trim removed, and only a hallway with about half of the sheetrock removed on the bottom 2 feet. A water mitigation company has filed a lien against our home because we are protesting paying their bill which was $16k over the $28k insurance already paid. Insurance will not pay any more until they review discrepancies in the bill. The company refuses to engage in reviewing the bill and items we identify as errors, etc. They got my husband to sign a contract that had no $$ amount listed only agree to pay "TBD". I did not sign the contract. I am one of the two homeowners (my husband and I). Is the lien filing legal if i didn't sign the contract? Any recommendations for next steps? ...Read More

I run a roofing company here in Dallas Texas . I had a customer sign a contract for me to do her roof which states that if she cancels then a 33% fee will be charged . She decided to cancel after she received her check and went with another roofing company . We did not do her roof but she canceled our contract after we helped her with her claim . My company got awarded an apartment complex re roofing job with over 80 units on the property. I am wondering what is the best way to get paid on time with this project. It is a government entity job with the housing authority in EL Paso Texas. I want to make sure we get paid on time and am wondering what is the right way to make sure we get paid. In the contract it does indicate we wont get paid until they get paid etc. If you can let me know any advice for this type of project and payment. I am a man who lived with a woman as husband and wife for more then a year. Together we purchased a 2017 Chevy pick up from a dealership and financed the truck. It was done for my personal company. Without notice she made me move out and she turned the truck into the dealership to purchase herself a new car. Her reason: she just does not feel the same way about me.... It ended my company ability to operate. I paid over $10,000 on down payment and monthly payments..Not including insurance. Her unwillingness to talk to me required purchasing another truck around $10,0000. The truck is in her name. I paid all. Her income does not support the purchase. Even though we were not technically married we were as such with each other wearing rings. This is the situation along with the dealership could not make the deal with her purchase. My question is as following : 1) Client has awarded us 100 $ worth of a job. 2) Client wants to open LC for 15% of the said job and "Claims" it can be re-utilized again and again as progressive milestones are achieved on monthly basis. 3) What kind of surety or clauses should be mentioned in the LC draft which secure and guarantee 100% of the project payment without any suprises mid way during construction or cancellations of LC by client during the job ongoing or to avoid delays in securing timely payments??
