We just did a roof for a man and in the process of wrapping up odd and end stuff the man got mad and kicked us off the job said he wasn’t going to pay. I did a high-end glass tile install on a spa in Brentwood TN (suburb of Nashville). I gave HO instructions on running the nearly black glass infinity edge. They were told (and recall it) that the edge was to be running (flowing over) if it was above 70 degrees and sunny or warmer to keep the tile cool and avoid excessive thermal cycling. They set the edge to turn on at 5pm daily for the first summer and the tile tented at the properly installed expansion joints. (I put them twice as close together as required by TCNA EJ 171 would require as the install was in direct sunlight and almost black. The customer wants it fixed and the husband has voiced that he understood that it was improperly run and knows that is why it failed. His wife however has a totally different opinion and has tried to get litigious. They have brought every top expert in the industry using NDAs to keep me unaware and their best efforts to find fault with me have failed. Now that they have learned the truth about why it failed and have been told that my install was probably as good or better than any of them could have done, they want me to fix it and pay me. I want to protect myself from any litigation and potential failure to pay before I agree to do anything. A hold harmless agreement at the very least. Can you help me contract and write "hold harmless agreement" for such a sensitive project? What I need is an outline of the documents needed to proceed and successfully complete this repair job estimated including all materials and expenses at 60k....Read More

Hi not sure if you can advise on Tiny home contractors. It seems there are not laws that protect from contractors that are requiring payment in full up front for the construction of their homes. Once the money is in hand there is very little or no communication on the build date. I currently have a friend that paid for her home a year ago. The trailer it is to be built on has the flooring down and plumbing. Which was posted on a co-construct site from the company in October, now three months later no additional work has been done and she is still waiting. As stated before her home was contracted and paid for a year ago. At that time the builder stated many times on his YouTube channel that the homes took about three months to complete. She also paid $6,000 for her leased lot in the builders tiny home community which was to pay for her lot rent for the first two years and a lot rent of 200 a month for the next three years and beyond. Her first year of free prepaid rent started the month she contracted and paid for her home (even though the home is not on her lot due to the companies inability to fulfil their order). She is not the only customer in this position while its impossible to know the number of clients effected it could be in the thousands. We know of contracts of at least a hundred that are not delivered. The builder who is over a year behind in construction, just sold one hundred incredi-box specials at 20,000 a unit cash up front to unsuspecting clients. If my math is correct that's 2 billion dollars collected up front. He can't even produce the homes that were contracted a year and a half ago. Many of these clients are veterans with limited income and or low income consumers. If sued I'm sure they could get their Money back, but the value of this home has doubled. The builder has people over the barrel, if they sue they are going to get their money paid back and the builder can then sell their homes for twice the amount. Ok I know I’m not un-fairly paid, I make a dam good living. The contractor I work for is sub onto jobs and he 1099 me as a sub to get larger projects done. we just had a wage rate job in Memphis pop, but he can’t figure if he as a sub contractor can sub me onto the job since I’m not his employee. I am not paid hourly and truly don’t want to be since I make way more doing work by the piece. How do I find this answer?...Read More

We have a pretty airtight case against a GC who did not pay their final draw or the retention after acknowledging payment issues on their end and a job well done on ours. We contacted an attorney and filed suit. But yet again, we are being told the contract isn't the issue, we just need to settle for $50,000 less then owed (not including late fees due by law and signed addendum to the contract). Every time a GC violates the contract in order to pull something over on a sub, it seems impossible to find a lawyer to actual litigate the case. Settle, settle, settle for significantly less is all you get. Well, that and a huge legal bill that they want paid in full for their work. My cousin rented out his spare car to me. The deal was that he would pay for any repairs and fluids that the car needed while in my possession. He did not do that.
