We were served with Notice of Intent to File Mechanic's Lien. I replied to the attorney's request for information and also requested evidence which was ignored. The project was completed in August and the final invoice was sent August 9 and paid by us August 12. The lien has absolutely no merit and is 100% fraudulent; however, we believe the threat to file a lien in an amount that exceeds our contract price by $63,000 is revenge for a complaint filed with the SCLLR against the GC for damages to our property due to negligence, threats made by GC, and the GC intentionally slowing down our project because he underbid on the quote. We retained an attorney in August who sent a demand letter, and the matter was settled once we confirmed the GC and subs were no longer on our property and we agreed to the final invoice amount and paid the invoice in full....Read More

Good morning. We are a GC firm based in Tennessee, with a multi-family development South Carolina. Due to the ongoing labor shortage, we need to bring some of our subcontractors in from other states. However, these subcontractors have not worked in SC before and are unlicensed in SC. Under SC licensing laws, may ancillary subcontractors work under our BD5 and WL5 licenses? Ancillary subcontractors being concrete, masonry, framing, drywall, roofing, etc. If so, is there a list of classifications that can lawfully work under the umbrella of our BD5 license? We are a GC constructing a multi-family development in South Carolina. We carry a Building-BD5 (unlimited) and Water-Sewer Lines WL5 classifications. We understand that electrical, plumbing, and mechanical classifications require licensed subcontractors. But, can unlicensed subcontractors work perform ancillary work under our license? Such as framing, drywall, concrete, masonry, painting, roofing, siding, etc. Is there a comprehensive list of trades that can perform work under a GC's license in South Carolina? Contracted a company to build a sunroom in April of this year. The project has not been completed as of November 20, 2021. I cannot get a straight answer for the owner of the company. It varies from waiting on supplies, and workforce. The answer recently has been its' sitting on a "Ship somewhere on the ocean". To make matters worse they have over $14,000.00 which is half of the cost of the project. Additionally, the building permit has expired, which will be need to refiled and paid again. I've called and emailed with no response; only once did I have the opportunity to one of the owners. It didn't help, he just kept saying six months for windows and vinyl. We are way past six months at this point. Help. What type of formal letter can I write, requesting a completion date. Where do I start....Read More

Had a written agreement with a hotel owner they agreed to pay a selected amount on a agreed date every week and they have missed that date on two consecutive weeks now they want to reduce the agreed payment to a lower amount weekly after violating a written contract then a verbal contract on two separate occasions. I hired Leaf Filter to install new gutters and their product. Contract with clear specifications written. Payment is/was due on completion. Leaf Filter subcontracted out their work. There was an issue with a smaller part of the job and the subcontractor and I decided to hold off on finishing, which was approved by Leaf Filter via phone. The office stated they would figure out the solution the next day. Next day came and left. Leaf Filter never called me nor did they communicate with the subcontractor (I know because the subcontractor gave me his contact info) However, Leaf Filter did attempt to run my credit card for the entire job that day. The card was frozen for safety reasons and I got an alert. The second day after, Leaf Filter called and complained about the card declining. I stated that the job was not completed. The next thing I know, Leaf Filter is threatening to put a lien on my home for non-payment. They know the job is not finished, but told me that I either pay or they'll filing the lien. I recorded the phone conversation. They even told me that they would put the gutters on if I released the freeze, but would not agree to complete the work first. The Subcontractor is pissed at Leaf Filter and said they are just bullying me. They state the job wasn't finished so they can't file the lien. Can this large company do this? My company did a residential rehab project in Orangeburg SC, the client asked that the original contract be revised due to a misunderstanding ( she suggested that I start working in both bathrooms at the same time. I said no I'm not doing that bathroom now, I've come to learn that she thought I meant I was not going to do it at all. When I actually meant it is not a good practice to have both bathrooms inoperable at the same time.) she had no input on what she'd like the revised contract to state. My changes were how the monies were to be paid going forward, she refused to sign the contract or offer any suggestions to try reach an agreement. A homeowner doesn’t want us to work on her flooring anymore due to her believing it should be done how she sees fit. We have completed half the work. The total amount for labor not including materials was 3500. She paid 1152 upfront as our required deposit.
