We are a landscape company here in North Carolina and we have recently performed a landscape installation to a commercial property in South Carolina for the General Contractor for that project. We have performed all of our duties according to contract. During this project, much of the landscape was damaged due to other subcontractors working at this project, we sent numerous emails to general contractor with pictures of the damages including multiple change orders and they were not approved. General contract is now withholding final payment for us not repairing the damages caused by other companies. ...Read More

A Homeowner hired Coastline Renovations LLC, my Company snd I'm Sole Owner, to install trim and paint it. We signed a contract, wich Ben Wassell the homeowner signed as his LLC The Truck Guy LLC. This work was for his home here in SC. I signed for 4500$ and no deadline. I did tell Ben verbally 7 to 10 days should be finished. The first day I received 2250 deposit in my PayPal account and it then was froze for a new limitation. I explained to him I have to have it clear so I can purchase materials. I was sent 1000$, so I took a day for materials next day worked and at end of the day Ben asked for my license and to be there on inspection. I then knew something wasn't right because that type of work doesn't require license in SC. I did send my Articles of organization over and explained I had things to do. I wanted to see what was really going on. That 3rd day Monday My PayPal had already a Case filed for a refund from Ben and not sure what was said in the case but my account is now Permanently restricted and I can't touch the money. Also because I told him I don't have to be there for inspection and he didn't need my license, he told me he finished the job. Himself to get my tools and refund him. He had already went back to New York as well. I found out it was an insurance job and he wanted to use me as the contractor for whole job to keep the money. I explained he is in breach of contract and I need paid in full. He said no so I sent a notice of on job and wavier for furnish materials and labor payment. Still nothing so I told him I will file a lien and he told me to go ahead he will not pay. I believe he intentionally had my PayPal account locked and never planned to pay me....Read More

I am a drywall subcontractor that worked for GC (KTM) Their law firm send me a letter saying the lien is invalid on its face and was wrongfully filed. I send request to LEVELSET to file a lien on 4-05-2022 (10 days before the 90 days), but Levelset filed the lien on 4-25-2022. I got copies of the liens and letters, also I sent on March to the GC the Notice to Intent to file a lien. Also, in case the lien is filed late what about my retainage (10%). Please I need help. Three years ago we had an AC company install our new AC, we signed a contract that the work would be completed in three months. We’ve had nothing but problems with this company, not finishing the project, not returning our calls and he finally came out and told us he was charging us $1500 more to fix the reason the unit wasn’t working. We said we were not paying it and that he broke the contract. He never put in the warranty info for the units, so we put in the dates online as the owner and called another company come out to fix it under the warranty. This was last year. Now he shows up out of the blue the other day wanting money and threatened to put a mechanics lien on our home and says he will ‘double the amount because we haven’t paid him the rest of his money plus the extra he tried to charge us…..what recourse do we have as homeowners who were left with this guy threatening us like this after such a long time? It’s been a year since we had the other company come out, so isn’t the time frame past that he can even file a lien, and didn’t he break our contract in the first place? Can he make up dates and paperwork to file? He has never sent us anything in writing we only have the original contract….thank you for your help. ...Read More

I am a contractor out of South Carolina and we do a large range of service calls through leads we get from the Handy Technologies company, however we have not been paid for many many jobs that have been completed. They try saying its because homeonwers never marked the jobs as completed on their app or whatever. Even right now, we have done thousands of dollars this week, worth of work for the lead company yet havent been paid any of it. What is my option to enforce payment, and basically let them know we do not play around when it comes to non payment. They get leads from HomeAdvisor as well. Many times we have been stiffed through them even out of our estimate costs. We charge a 100-150$ fee to even come out to the home or property, as it weeds out price shoppers and tire kickers. Yet the homeowner just cancels the job and claim nobody ever showed up. Ive got gps trackers on all our company cars and know when people show up to addresses. Would an attorney who knows about the suits against Handy Technologies, be able to help me? They are a good stream of constant service call work, but their payment issues arent good. We are an Architectural Casework/Millwork company in Virginia. We manufacture our casework here in Virginia, but hire subcontractors to install the product at the job site in South Carolina (and other states). When filing for a business license in South Carolina I was told that we were not compliant with the South Carolina Secretary of State. After contacting them, I was told that they need our SC Form 1120S. We do not file taxes in SC or the other states because even though the projects are in those states, we are manufacturing the product here and shipping it to that state where the outside subcontractor installs the product. According to our Accountant, we are not subject to taxes in that state. Can you tell me if this is correct?...Read More
