My company iink payments is a lender restoration professionals including; contractors, property attorneys, and public adjusters. My question is that I know we can file liens on behalf of the contractors since they physically provided the labor to restore the home. However, a public adjuster, is just negotiating a higher claims payout for a 10-20% fee. If the homeowner does not pay them are we able to legally file a lien on their behalf? Essential Home Improvement,LLC PO BOX 454, Mount Pocono, PA, Residential lawsuit The following is a letter sent to the plaintiffs lawyer and gives my overview of the situation: I have received your clients claims and request for a refund of four-thousand three-hundred seventy-five dollars ($4,375). I have contacted your office multiple times to discuss this matter and have not received a response. I do not agree with this claim for the reasons listed below. Your client breached the contract by adding additional work to the original scope of the project. Drywall in living room ceiling with a 16' peak. Drywall, tape, spackle, prime and paint the entire downstairs floor, two bedrooms upstairs; this was also completed on the living room ceiling. Your client imparted changes to the existing sliding door to be relocated. They also requested two rooms to be closed or altered. Your client also changed the original paint choice from non brand specific to semi custom paint; which resulted in approximately four- hundred dollars ($400) which they did not cover. In addition, my company fronted the installation of a new 50 gallon water heater at the cost of one-thousand two- hundred dollars ($1,200.00) which was to be refunded to me by your client. Your client requested electrical modifications for lighting and fixtures which are not included in the original scope of work which cost four-hundred thirty-seven dollars ($437.00) Your client fired me without warning, on the spot, and gave my less than 24 hours to clear the project site. This action negatively impacted my work flow, schedule and payments to workers. Your clients action also potentially cost me additional work and working partnerships as this was done in the presence of outside workers and an outside company. I'm willing to forgo legal proceedings if your client agrees to a settlement of two- thousand three-hundred thirty-eight dollars ($2,338.00). I would like to resolve this matter as soon as possible. I am a carpentry contractor and I subcontract from various companies to build decks, porches additions etc. I've done many jobs for Magic Home Services for which they pay me piece rates per square foot of deck or roof, per linear foot of hand rail, per footing etc. I have been paid $2,500 on a job that I thought paid $7,000. When we wrote the notice of intent to lien it was for the difference, $4,500. Now upon writing an invoice I see that the total is actually $8,807, leaving a balance of $5,807. I am a Code Officer in a small Borough in PA. Our Third Party Inspectors issued a Certificate of Compliance for a newly built house. The problem is that the deck was erected with 4X4 posts that are more than 32" high. They had the homeowner sign off on them and told me it was ok to issue the COO. My question is, do you think this is standard practice to have someone sign off on something like this? I feel perhaps the posts should be changed to 6X6 before the COO is issued. Our shed got damaged by a storm and needed to be rebuilt. We got money from insurance and hired a construction company to come and rebuild the shed. They used wood and the floor in the old shed to build new one. This means their materials cost would be significantly less. There was no set price agreed upon and no written contract. We gave them a check for $8000 and said we’d give them the rest when it was finished. They came and put up the shed, but did not finish (windows, doors, leveling, moldings, etc.) They then sent us an invoice for $30,000. We told them we will not pay until job is complete and we don’t agree on $30,000. (We contacted other construction companies and got estimates of no more than $16,000 for the size of the shed).
