I am a homewoner who contracted with a Stucco company for stucco remediation. What should have been a 1-2 week project has been going on for over 4 months. They say they'll show up, but don't - and no one calls with an update. I've approved payment for 2/3 of the agreed upon price, but there has been damage to my home over the 4 months due to the project delays that they still have to come back and fix - and I worry that they won't come back to finish up, so I've communicated that the remaining amount will be approved once all work is done (appropriately) and we've completed the final project walkthrough. They keep threatening a mechanics lien. If I'm the homeowner and still have outstanding work to finish up, does the contractor have a right to file? Do they have to first send me a NOI? ...Read More

We are a small subcontractor. A GC we are working with says we're not performing, so they've been buying material and backcharging us. The contract says they have to give us the right to cure. Wouldn't that right extend to them buying materials and backcharging us. They also haven't been paying us....Read More

I'm the contractor that provided services/materials at a residential property. The homeowner's lawyer is battling with insurance co. to collect funds in order to pay us. The lawyer sent me a general letter advising our lien will be protected and we will be paid when a payment is made to the homeowner from the insurance co. Is there a type of form I should get signed by all parties that protects us and guarantees our bill be paid as soon as the homeowner is given the funds? State is SC. ...Read More

My company is a small electrical subcontractor. We are running into some material procurement delays because our GC Customer has been slow to release payments. According to our contract, the GC has to provide us with a formal notice to cure any issues, with 72 hours of time, and up to another 48 hours on a contingent and discretionary basis. No formal notice to cure was provided, and 3 days later the GC purchased all of the outstanding materials, said they would be backcharging us for the cost, presumably plus a 15% administrative fee. This type of action wasn't stipulated in our contract documents, explicitly or otherwise. Now the GC wants us to essentially perform labor, at a loss. Is this legal? We should obviously contact a lawyer, but I'm looking to get a better feeling about the legality of these actions before doing so. ...Read More

I was hired given a contract by a property management company and the owner approved the work to be done. He decided to have all work stop before it was complete and sold property. He is refusing to pay the labor charges associated with the remainder of the bill. Is it the property management companies responsibility to acquire the money and do what ever legal action needed?
