In Pittsburgh, Pa. Subcontracting on a basement remodel. I gave a bid for the exact work to be done. I was to be paid for all material prior to starting, only received partial payment. Prior to and during the rough in I was asked to do extras not in my bid. I performed these. Paid for panel and rough in inspection, passed both. Asked for payment on the panel install, received a refusal. I am at the stage where I’m finished until trim and did not install new breakers for the work not paid for. Spoke to homeowner and said your contractor is not paying, so I kept the panel front with inspection sticker and rough in inspection. Told contractor I would not proceed until paid for the panel work and extras. He refused and claimed I quit. I sent invoice for payment of all work since he claims the homeowner does not want me to finish the work. I have all emails and texts....Read More

I took my car to a shop for a transmission repair and was quoted $3,500. I paid that before they started working on my car. The guy keeps pushing back when I can pick it up and hasn't called me about it once - I've called him several times over the past three weeks to see how the progress was coming along. I was told last week it would be done early this week. I called Wednesday because I hadn't heard anything and he said it would be done by the end of this week. I called today (Friday) and he said it would be done Monday or Tuesday this week because "the damage was worse than he originally thought and he had to order more parts." Now. He didn't say anything about a price increase. He never asked me if he could do additional work, other than what we agreed upon and what he quoted me for. He didn't even tell me what extra parts he had to order or explain to me what else was wrong with it. So, I'm wondering if this guy is trying to rip me off. I've done some research and in PA, Consumer Rights says that a mechanic cannot charge you for additional work that you did not request/consent for. Which, obviously I haven't done either of those things. So, if I go to pick up my car and he hits me with additional costs for repairs I did not agree to or consent to, can he put a lien on my car for not paying them?...Read More

I was called out to provide emergency sewage cleanup services on a home in PA. The situation with the property was unique in that the buyer was living in the house prior to closing due to issues with a flip contractor hired by the seller. The owner at the time/ my client electronically signed work contract from across the country to authorize my mitigation services. The buyer/ resident disclosed that the seller agreed to sign an addendum to the property sale to assume financial responsibilities for damages in the home likely caused, in part, by their flip contractor. I completed work and submitted all documentation to client/ owner/ seller for payment. The property was sold almost immediately after I sent the docs to the owner. It has now been 90 days and the client has ignored my numerous attempts to collect on the debt. I now find myself in a tough position. Do I lien the property and force the buyer back into the situation to leverage the addendum of the property sale back on the seller/ client? Is there a better way to collect the debt that doesn’t involve the indirect client/ new property owner?...Read More

This is a part of a contract that I, after 17 years in the business have run across, and would like to get an opinion on the legalities. I live in the Pittsburgh area. C. The Company will deduct $100 from each paycheck until a retainer is met in the amount of $1500.00 to be held by the company. This is my first time and I am having trouble filling out Section A Supreme Court of Pennsylvania, Court of Common Pleas, Civil Cover Sheet for a mechanic's lien. It wants me to check a box for Commencement of Action but I am unfamiliar with the selection of choices, their terms and how they fit my situation. the Commencement of Action selections include: -complaint -writ of summons -petitions -transfer from another jurisdiction -declaration of taking Here is my situation...I am filing the mechanics lien to recover money (~1700) owed to my company by a client after a job was stopped per the client's request. The cost of labor is what is being requested. What is my commencement of action, given the previously stated options? Other questions I need to answer from section A include: 1. are money damages requested? yes or no. I assume yes because I didn't get paid and am looking to recover that, hence the reason of the lien. Hello, Here is a series of events. Hired first contractor (Will) to rehab a house. First contractor did not finish job, payment plan with us, he could not finish the job and still owes us roughly 16,000. First contractor hired sub-contractor (Ron) to do the HVAC, however, he did not pay the sub contractor. We paid the first GC 12,000 to pay for the HVAC but never gave him (RON) the money. We found the sub-contractor and decided he could be the general contractor to finish the job. However, he was not working to our standards and was let go. My company iink payments is a lender restoration professionals including; contractors, property attorneys, and public adjusters. My question is that I know we can file liens on behalf of the contractors since they physically provided the labor to restore the home. However, a public adjuster, is just negotiating a higher claims payout for a 10-20% fee. If the homeowner does not pay them are we able to legally file a lien on their behalf?
