We are a framing subcontractor and one of the jobs/buildings we worked on has been occupied and open for business since early July, 2021. Does their move in and start of business trigger substantial completion? And if so, does this give us 90 days to file our lien from that date? We have not received word that NOC has been filed yet, but we have an outstanding balance plus retention that is yet to be paid from them. Our GC hired a lawyer and we want to make sure we are protected as well....Read More

i have a few different projects that are new subdivisions/ neighborhoods... all by same contractor they are single family homes some are sold and some are not sold all with different addresses . They are all under one contract do I have to send a 20 day notice to each house on the project weather they have a owner or not and or just to gc ? Or do i send the contractor notice with all the locations on it? ...Read More

Hi, I notice at the the bottom of our prelim that it says signed by Carrie Ogle, but it has Chad Schmidt signature. Will that make it null and void? The project is over we are just trying to fight for payment and we dont want this to be a problem for us. ...Read More

I'm a subcontractor who has finished a large multi-family project (5 duplexes). For 3 months, we have been told by the general contractor that the bank is not taking applications for retention at this time. One of the duplexes has been listed for sale, and the rest are all complete as well. No notice of completion has been filed. Should we proceed with a notice of intent to file a lien?...Read More

OK. So, we were hired by a sunroom dealer to install a sunroom and french doors for access. This is our second project for that dealer. First project went fast and got 100% payment at completion. This one was bigger and had some supply delays. Nonetheless, we got to 95% complete and still had not received the required progress payments (as required in our digitally accepted agreement). So, we issued stop work notice (as our contract allows) and still no payment from dealer (after 10 day notice to correct has expired). The amount due exceeds small claims court. Homeowner knows a lien is coming and they are understanding and is upset because they already paid the dealer in full. Yes, they now know they should not have done that. Upon further due diligence, the dealer does not have a H.I.S. license or contractors license and their business license is expired. I just want my money and let the chips fall where they may. Have I missed anything? How can I collect my full pay first? I have a suspicion the dealer is operating illegally and could get in big trouble from CSLB? ...Read More
