question for state of Oregon. can contractor who had contract agreement with owner directly send PRELIMINARY NOTICE through certify mail, without law firm representing the contractor. - estimated price was given for mitigation to be done, our company does water/fire restoration. client called said that her insurance already paid her for the job to be done, mitigation. our company didn't know what we were going in, because demo needed to be done to dry all the walls and floors. client agreed that she will be charged per hour. she paid retain age fee about 50% of the job done. once final bill came in after clean up , demo, and drying time, client refused to pay and said she won't do it, because she thought it was going to cost her less, actually firm price was never given upfront and client was aware that she will be billed per hour and per drying unit and daily reading drips....Read More

Hello! We had electrical work done on our house but recently found out from the city inspector that it didn’t pass inspection for several reasons and additionally, were informed the same day by a different licensed electrician that the work was extremely substandard and not well done, nor did the work meet the goal of what we wanted (moving from a 100amp panel + 60am subpanel to a 200 amp panel). We have disputed the charge with our credit card company and now the contractor is threatening to put a mechanics lien on the house along with taking us to small claims court as he believes the work was finished. With regards to the mechanics lien, we never received any Oregon CCB documents prior to the work being done, so we’re wondering if that lien would even be legitimate on their end? ...Read More

I provided labor on a residential structure as an employee working under a subcontractor who had a contract with the general contractor. Its been over 8 days since I provided my services and I havent gotten paid because the general contractor is refusing to pay the guy who hired me. Am I entitled to file an Oregon Lien to get paid for my labor? Hi. I am writing as a homeowner looking to get some home improvement work done (previously hardwood floors, now carpet installation). Maybe it's because I'm not a native Oregonian, but I'm feeling uneasy about contractors wanting me to sign the Oregon Lien Rights document. I'm happy to make a commitment to pay the contractor, but the document seems to indicate that a lien could be placed on my property by any subcontractors or suppliers the contractor fails to pay or has a dispute with. Maybe I'm misunderstanding it, but it seems to put a lot of liability on the homeowner, to the point that I'm uneasy moving forward with projects. I've spoken with different neighbors about this and some seem to think I shouldn't worry about it, whereas others say they've never been asked to sign this document.
