An (Oregon) contractor did work on our house 5 or 6 years ago. As far as we know, we've paid everything he's billed us for. When he was doing the work, he presented us with an invoice monthly, and we paid him on the spot. I think all in all we ended up paying him about $70k. There may have been a few times that he came back to finish up a small detail or revise something we weren't happy with. Small things. We never received an invoice for these things. Shortly after that, we had a few small items we asked him to take care of for us. We asked over and over for him to give us an invoice. It seemed like he had problems hanging on to a bookkeeper so he would just say "I will", but never did. Since then everytime he's come to do any work for him, we paid him cash before he left. We didn't want his fees to pile up. We asked him to send us an invoice for the work and the payment everytime, but he never did. My sister had him hang some doors 2 years ago. She paid him. However, that got me to wondering what we would do if he presented us with a bill? How many years are we on the hook to him if he comes knocking with an invoice for work he did so long ago? I'm a service provider/sub to a prime on a contract that is under dispute of whether it falls under the private or public work umbrella. The prime hired us to clean a parking lot that they only leased so they could use it for a staging area for a public works project, but when we filed a claim with the bonding company it was denied. The prime assured us that they would pay in full multiple times on the phone and even made a partial payment, but now will not communicate, respond to communications or make payments against what they owe. I sent the original proposal to Fortify Holdings, LLC. I did work on four hotels and our agreement was that I was to be paid for each property upon completion. They paid me for the first three hotels and a partial payment for the last one but they still owe me $3488.00 and it has been over a month since I have invoiced them and their representative who I have been dealing with won't answer his phone or return my calls. I had problems getting my money on each hotel but they really needed the work done and I wouldn't move onto the next hotel until they paid me for the work that I completed. Now on the last check they aren't wanting to pay me. My question is who do I send the Intent To File A Lien to: Fortify Holdings, LLC or CV The Jackson, LLC where the work was actually done?...Read More

I had a rent to own contract for one year. The manufactured home was completely unlivable. The bank would not even Finance the home. I had a year to fix it up with my own money and get it financeable while I also paid $1000 a month in rent that would not go towards any payment for the home. I spent over 20,000 out of my pocket to completely gut out and remodel this manufactured home with a contract between the owners and I that they would sell me the property for 210,000 once the year was up. With the stipulation that I would have 60 Days from the end of the contract to close out the sale of the home. Right Before the year was up I contacted a loan manager to get the loan ready and going. For some reason the loan manager was not able to close out the home by the 60 days even though I was in constant contact with him and he kept reassuring me everything was fine and we would be closing out on time. He was also for some reason in contact with the home owner letting them also know the progress of the loan. Right before the 60 days was up the loan manager told me he would not be able to close out the loan on time and he would not move any further with the home loan unless the owners agreed to give him 2 more weeks which they decided no they did not want to do. I should also mention I had to pay for the house to get appraised as part of the loan of buying it and it was appraised a little over $100,000 over the cost they were selling it to me for . I just went to court for eviction on this property and have 3 days to get out with no equity reimbursement or material reimbursement for all the work that I have put into it. What can I do about this and who would I talk to. I have a contractor's license would I be able to put a lien on the manufactured home until I am reimbursed for payment for the work that I've done?...Read More

I am an electrical contractor. We had a list of work to be done for a home that was being sold. The buyers' agent sent us the list and cc'd the seller along with a copy of the agreement between the buyer and the seller that the seller would pay for the repairs. We got a downpayment of $500.00 from the seller, but she hasn't paid us the bill's balance (about 3K). It has been 4 months and the seller is not answering our calls. So I am a contractor and was hired to pour concrete and erect a building. Concrete done, building fully erect, then the owner wants the building to be insulated. So we added to the contract. Anyway in an off day (Sunday) the owner and his wife decided to go and “work” on the project building”, we know this becumause he told my workers and also stated this fact in 2 of his emails as well as a termination contract between he and us. Anyway, since after that time he has been nitpicking and breathing down our necks about every screw and measurement every second and frankly we are sick of it!!! We asked for a progress puke t and that’s when things changed… he refuses. Now he has a termination contract sent to me and demand befor he would issue half of the progress payment that I asked for ?
