I am a GC and contracted a whole home remodel for a client. They wanted to move quickly and were hoping to move into home by February 28, 2022. The permitting process took 3 months when we had never had it take longer than 3 weeks. The county was implementing a new system of processing permits and had a huge backlog. We added a significant amount of change orders on top of the original contract and ended up complete enough for them to move in on 5/31/22. They are claiming we owe around $25,000 due to delay costs for them, as they sold their home and had to stay at an AirBNB and store their belongings. On top of that we are still owed approximately $64,000 and they are saying they will settle for no more than a wash. Meaning owing us $0. They hired multiple contractors outside of our purview that cost us a significant amount of time to coordinate with and supervise. They also added multiple small projects to my crew, and the work was completed that they are now claiming they should not have to pay for after telling my project manager they would happily pay us for any of the additional work. They are saying they are happy to go to court and they are stubborn. I don't believe they have a legal leg to stand on, but would appreciate some insight on next steps....Read More

I have paid about 65k to my contractor and he is unable to do the work. He seems to have no money and has spent the money I’ve paid him. He has a 20k bond in which we are due. we are a supplier/manufacturer. we have a contract with a subcontractor to provide some material. We do not have a contract with the GC. our customer has been asking for a lien waiver but keeps insisting we need to sign off on it as if it says we are dealing with them and with the GC. (They want us to sign a notary statement about their payment applications to the GC.) This doesn't seem right since we are not a party to the prime contract. I have a contractor that never finished a job. I made many attempts to work with the contractor for 30 days to complete the job, but they were unwilling to work. They are now threatening a lien on my property (although they have never even billed me for the job). I have since hired another company to come in and completely redo the job that starts next week. If they do file a lien, do I get a chance to file the documentation that I have that shows they didn't finish, nor even accomplish any of the line items on the contract? They also were unlicensed while performing the work. I'm not sure if it is an idol threat or what. I feel like I'm dealing with a Nigerian Prince type of operation. But am a little concerned that they might actually file a lien. And I don't know what it takes to fight such a lien....Read More

I have recently changed up the way I create construction progress waivers which are signed by our vendors and then submitted to our customers (the GC.) This both reduces chances for errors and cuts my waiver creation time in half. Part of this requires that the conditional month always be listed (i.e. 10/1/2022 - 10/31/2022) and if we're unconditional I'll put $0.00 in the conditional side and 10/31/2022 in the unconditional side. Is this accurate? Logic dictates that a payment of $0.00 would automatically be "received," making the conditional wording accurate. I just have one or two vendors who are completely confused by this. But this is a huge time saver for me and I believe it is fully accurate. I've not received any push back from the GCs (even the ones who like to push back for the sake of doing so.)...Read More
