Subcontractor's Bid Document to GC has "Very Specific Language" that acceptance or awarding of the Bid requires a signed contract between both parties (GC & Sub as named in Bid Document) . Bid is selected and awarded by e-mail by the GC with no acceptance by Subcontractor and Agreement cannot be reached on contract language and/or other contract requirements with "no signed contract existing between GC and Subcontractor". The Project starts with other subcontractors doing their contracted work - am I liable for the work that I bid on with damages to General Contractor because the GC most likely cannot meet their construction schedule with Owner because the GC has to find another subcontractor to do the work that I bid on?

We are the CG on 2 public school projects in Ohio. The projects that are already recently started, but I cannot locate Notices of Commencement on the respective county recorders' websites. Should I still file a NOF immediately or wait to see if the produce an NOC? Since we are the GC should we file the NOC in 10 days if the NOC does not appear to be filed? Or would we need to be specifically asked by the school to be an Owner Designee? In that case should we also file an NOF or just NOC? Also do I need to obtain bond information and how? We are bonded, but I'm not sure, should the need arise, how we would make a claim against the public bond without the info.

A friend took it Upon himself to start digging a hole along the back of my wall on a project I had been talking about doing . And what was the easiest way. As stated I came home to him digging. I purchased a building that had a $600k mechanics lien filed on it. The contractor filed it to protect their interest and is currently in the process of reaching a settlement on the final payout with the insurance company that is responsible for paying. I purchased it to subject to the lien. I now have a refi that is helf up until this is settled. My title company told me to look into having the lien bonded off. people bought used cooler, they never saw it operate. called us, we told them it had a clogged cap tube. we told them 3 possible scenarios. we got their permission to try the 1st ,least expensive option. it worked for 5 hrs. we called on follow up that evening, they said it was down to temp. they called back approx, 1 half hour later, and said it quit. they did not pay us. was told they sent check out in mail, that same afternoon, after we left. we agreed to order the parts they needed, to go on, with level 2, repair. they said ok. after 5 business days, no check , they began pressuring us to continue repair regardless, or they will sue us and make us replace the used cooler with a new one. we have done nothing wrong. what should we do? ...Read More
