I have completed a home renovation project using a general contractor. The contractor used subcontractors. I will have a meeting to make a final payment. At that meeting, I want an unconditional release from the contractor for all claims, liens etc. by the Contractor AND any subcontractor or materials providers the Contractor used on the project. We have a project that we completed for a brewery located on an apartments property. We attempted to collect payment for the project that we had completed about 3 months ago but were told that they (brewery) was waiting for a payment from the apartment complex before they would pay us. We filed a lien on the apartment to ensure we would get paid, but the Brewery says that the apartment won't give the brewery their disbursement now because we filed a lien. So they asked us to release the lien so the apartment will pay them and then they will pay us. As far as we are concerned our payment was not contingent on them receiving this money from the apartment so they should pay our invoice as they agreed to 30 day terms. In North Carolina, the statues state if I have no employees (or less then 3 to be technical), I do not have to carry WC. Now, at the time of being hired and on the job, I did have WC, as this GC claims his insurance company requires it. I keep trying to explain the law to him and that I do not. I finished the job, and while waiting 2 almost 3 months for everyone else to get done and pass inspections, the policy has now expired. He claims I need a new policy put in place just for them to write the check because their insurance company will audit them and it has to be there that day. I said no, it has to be there while I am on the job, not when you finally get around to writing checks. I do not plan to work for this client any longer and do not need to spend $1,000+ dollars just for them to mail out a check according to the law as I know it. Is there something I am missing? Or is there a way to make him send it? Lein the job? Have a lawyer send a letter demanding he is illegally withholding the moneys? What can I do other then wasting $1,000 to get 2?...Read More

Hi Lawyers: I hired a General Contractor to build an "in law" house on my North Carolina property. There was no officially set delivery schedule on the time and materials-ish contract. The project is near done, but has taken 2 years, through multiple excusable and inexcusable delays. We had a serious talk, and I demanded he needed to communicate ahead of additional; work, and delays. He agreed, claiming he had gone through a "personal rough time". 3 months afterwards, more delays, causing the electrical utility to postpone connection. The GC has stopped returning calls for the last 2-3 weeks. He failed to provide the utility (Duke) a response to required paperwork. Do I need to take any action before getting a lawyer to help with this ? What kind of law firm? Thanks...Read More

My company filed a lien of real property against the GC, he sold the property, and prior to the sale, we failed to file notice of lien agent. (NC lien laws are way different then our home state FL). The new owner sent us a letter telling us to cancel the lien, or they will move forward with a personal liability against us. So do we have any recourse? Could we file an intent to foreclose? and then move forward with a foreclosure lawsuit? or would we be better off filing a breach of contract? Or are we too late to do anything? What do we file?
