Many of my projects are billed in 3 phases ( 60/40/10). Prior to the release of payment, I request that my contractor provides a conditional on progress. After the first payment, should I be requesting a condition on progress waiver for the amount of the upcoming payment AND an unconditional on partial payment for any amount they have received to date? Is there a single document that effectively combines these? We work nationally so I have projects in all states, and most of my projects have 4-6 contractors and vendors....Read More

I (homeowner) owe 25% of the remaining contract on a remodel job. There are still a few items left but it is nearing completion. Major subcontractor on the job told me he hasn't been paid even though he completed his portion a month ago. Bad blood currently between them and he doesn't trust he will ever be paid. Contractor's partner called me today and told me to pay subcontractor directly (about half of remaining amount owed). I am happy to do this but am nervous without some sort of paperwork signed by contractor or his partner. Can I write up a contract addendum and ask contractor to sign? Would that protect me adequately if contractor claims I didn't pay full amount? Any particular wording I need to include? ...Read More

We are a general contractors that perform commercial and residential renovations. However, our client has refused to pay the final balance that is now past due for the services that we already completed for her home. We then filed a mechanics lien on the property. We are now ready to file a notice to foreclosure lien document since we still haven't received payment. However, we were just informed that a notice to lien document was required first in NC. Original owner hired us. Sold the property and is refusing to pay. Realtor had us do work on the house for the original owner and the new owners on closing day. New owner is an attorney and threatening to make this extremely hard for us because we didnt get paid. Realtor knew we had not been paid at closing. We are a specialty subcontractor for a project. We were told that all materials would have to be store in a warehouse at the projects location. Which means they will be the ones to unload the materials and place in a safe area. Our equipment and materials have extensive lead times, unique, and costly. We want to make sure we are covered at all angles like if a disaster occurs, material being lost, dropped, stolen, or anything catastrophic. Contractor has stopped new construction home build and is demanding payment for portions of the build prior to bank's inspection and funding of those particular items. Contract states that "payment must follow payment schedule per the bank's construction loan draw process". Bank won't approve any materials invoices unless it is partially or fully installed on the home. During the previous draw 3 weeks ago, GC communicated to us if we approve the draw (6 days after initial request), she will restart work, we immediately approved the draw and was wired to GC the next day. A week later, she is now asking for another large sum of money which is off cycle to the banks process and has stopped all work. The amount she is now asking for are invoices she paid after the last draw. GC has no billing cycle and simply demands payment at random times. How do we get the GC to follow her original word and restart project? We are only a few weeks away from completion on the house....Read More
