Ilm a home owner and hired a HVAC contractor to replace our aging heat pumps. The invoice had what woucl amount to contract terms incluing a completion date in mid Novemeber. It was silent as to canellation. He started to delay in Dec 2020 by stating he had the equipment in his covered trailer but thought he had Covid-19. Tests showed he did not have Covid-19. For the next 6 months he continued to have medical issues and said he could not perform. For the most we were sympathic and continued to ask him to give a completion date. He gave us dates then at the last minute cancelled. In June he final didn't show because he worked late the night before and was tired. We stopped being sympathic and continued to ask for an install date. Finally in June, he stated he had secondary exposure to Covid-19 and self quarenteed, then stated that installing our system was a priority. We acknowledege reciept of the notice. In Mid-August our system crashed. We sent a text ending the contract, mentioning our system crashed and requested a refund with in 15 days. We left the ball in his court while we contacted other HVAC contracts. With in a week one was able to install the system and we contracted with them to do the job. No deposite was required and we got financing. Now what do we need to do to recoup our deposit and not be held in breach of contract? Will he able to get a mechanics lean?...Read More

Hello, My question is specific to funding or allotments on the draw schedule related to appliances, hardware, windows etc.. Say for instance line 32 reads windows and doors and the draw amount is for $40k am I correct in saying that the builder has determined $40k will be need for all windows and doors? However, if I am not happy with his selection of windows or doors is it my right to try and find the windows and doors that meet our expecations with the $40k he has budgeted for? Of course if I should go over the $40k amount then I understand it comes out of my pocket. Thank you in advance for your help ...Read More

We are a subcontractor in Mecklenburg County, NC and wanted to know if warranty work is considered in the 120 days you have to file a lien. For example, if the last date we worked on the jobsite/provided material was in 2020 but in May 2021 we had to go to the jobsite for warranty work as well as paid a subcontractor that we had to hire, could we count the 120 days beginning in May 2021 when we did warranty work? I spent 14.5 hours deep cleaning a house. I told the owners a deep clean rough estimate started at $280, but I would not know the total cost until I was finished the job. The house hadn't been cleaned in a long time. Plus the had a 100lb pig, 3 dogs. Inside pets. The pet hair and grime was on doors, base boards, walls windows, furniture bed frames, everywhere-every door, windowpane, etc. had to be wiped with a new rag 3x. With crud critter or windex. Ceiling fans~black hunks of dust so think I used 12 swiffers on 3. Dog urine on basement floor. So I'm painting this picture to make one understand the labor & materials were triple of a normal deep clean. They refuse to pay when they get invoice because they say I quoted $280.
