My husband and I are painting subcontractors and contracted to paint a student housing apt complex from a company called turn University. To keep this on the shorter side I’ll skip the stories that were throwing up some red flags but ultimately after a couple of unsuccessful attempts to fire us we were down to a couple more units to paint and minor touch ups and we were told we were fired. We called the police and told them that we were wrongfully being fired and we were pretty sure this turn University was a fraudulent company. Started investigating and sure enough they were a fake company. Another Craigslist Scam. I found out the name of the company that hired turn University to do the paintwork cleaning and carpet cleaning for their turn . I managed to find the president of the company and filled him in. He had someone on a plane from Colorado to the job site in North Carolina the next morning. He had the “regional director” for turn University cornered and the scam was exposed and jobsite shut down. We have lots of evidence and even a 15 min confessional from turn’s regional director. We shared all our findings and even how the cleaning crew is involved planning on taking a lot of money from them. We have lots of correspondence with this company and they have stated they have all intentions of getting us paid but since we contracted the work with “turn” it is throwing up many challenges and has to go the legal route. I sent a noi but they did not want to settle up with us leaving us to believe that perhaps they do not own the property so now I’m working on finding that out. This group ends up being the moorish sovereign citizens movement which is classified as a terroist group here in the States with roughly 7000 members. We really need some advice and some direction as where to turn on getting our money. This has put us in a very bad situation. Any advice on this will be appreciated more than you will ever know . Thank you....Read More

Can I take any legal actions? The real estate agent is representing me and the builder. They originally set my closing date for January 31, 2020 but due to COVID and other delays we missed that date. The new closing date was September 14, 2021 and there is only a foundation laid. There has been no real weather delays and the builder is currently on vacation and no work is being done while is gone. I believe I may need to reserve legal representation at this point....Read More

We are a Georgia general contractor starting a commercial project in North Carolina. What is the difference in the project owner appointing a lien agent and the general contractor being required to file a Notice of Contract. I thought the process of appointing a lien agent was to require any potential lien claimants to notify the lien agent of their existence on the project....Read More

We recently hired a contractor to do work in three closets - add shelving, add a small built-in desk, change doors, add lighting, etc. He asked for 50% up front for materials, 50% at completion, which we paid. About a week later, he sent a photo of the built in desk for approval. The desk looked awful, so we did not approve. He got really defensive about it, so we told him to cancel the project and please deliver the materials that we have paid for. He is now refusing to return the materials, and threatening us with a mechanic's lien, saying that he spent more time on this than we've paid for, and we owe him for that. He has done no actual work in our home. Can he file a lien? Can we at least get the materials that we paid for?...Read More

My boss did some restoration work on a homeowners house. The customer has refused payment. His lawyer tried negotiating with them and they have refused. My boss doesn't want to invest the time or money in attorney fees on a 13k bill. I have told him to get a mechanics lien. Which route would be the best way to go in terms of time and money? Can he file a lien and not enforce? Is it possible to go all the way and get your attorney fees back? ...Read More

I have received a filing from the court for placing a mechanics lien on m y home. I had a new driveway installed for $7,100 and the first 40 feed was substandard. He also didn't follow our agreement for how it was supposed to be laid out. He also refused to do a final walk through after the work was completed. I have tried multiple time to get him to negotiate so sort of settlement. I have sent him $4,100 in registered letter twice and they were returned. I have told his attorney to tell his client to go to the post office and pick it up, but he refuses. Apparently he wants the full amount. I'm unsure as to what I need to do at this point. Do I need to file a response? If so Do I just claim substandard work and failure to follpow the contract? ...Read More
