I am owed $30,000 total. The Owner knows that they owe me $30,000 in total.I have placed a $30,000 lien on each of nine (9) unsold townhome units and I wanted to confirm this is OK or whether I should have placed a $3,333.33 lien on each of the nine (9) units? Does it matter legally? Of course, as soon as I get paid in full, I will remove all the liens from all properties, but I want to make sure the liens are valid as filed....Read More

The home owner is being the General Contractor for a swimming pool their put in and hired me as subcontractor to install the pool. Our contract states that I am not a general contractor and anything over 30k the homeowner becomes general contractor and subs work out to me. But now the homeowner saying that wasn't the case and not paying me the final payment because I'm not a general contractor and wasn't supposed to take on the job since it was over 30k. Since I have a signed contract stating that under 87.1(b) he was the GC and sub contracting the work out to me that was broke up into 4 phases & payments and after each phase could hire another company to complete that phase or continue using me. As well as he was responsible for pulling permits, hiring a licensed electrician to do the electrical, and have the fencing done to code and regulations. What can I do about this situation? I filed a mechanics lien on the home and that's when ge turned around and claimed I lied to them and told them i was a general contractor and now taking me to court for doing work over 30k. I need legal advice badly because I was under the assumption I was doing everything the legal way and as of now its his word against mine yet I have a signed contract and he has an estimate that claiming is the contract...Read More

I'm a subcontractor, who recently finished trim work on a new construction project, that's owner occupied. This gets weird. The homeowner is supposed to have a general contractor as required by their bank for the construction loan they took out. I was hired who I thought was the GC, only to find out he's not the GC. There's no GC on the job. Now the guy who hired me is not paying and told me to speak to the homeowner about my invoices. The homeowner says the guy posing as the GC is responsible for paying me, but he's not a licensed GC. I need to file a lien, and in this case it should be able to go against the homeowner and their property since there is no acting GC? Correct? Also since I'm a specialty/subcontractor is there flexibility with sending a preliminary notice? Can and should I still send that?...Read More

A concrete patio that we installed in our backyard in oct2021 (i think it was 11thoct2021). We worked with a contractor named Alex and we had and agreement to make cash payment to him for job. We have Facebook messenger and text conversations showing that we paid in full, the cash amount. We do not have any paper contract signed, but everything is through text messages and Facebook messenger. Now fast forward, the concrete company (whom my contractor and another subcontractor subconteacted) sent us a letter, snapshot attached, that we opened yesterday, 29thjan2022, where in they are asking for payment for concrete and other information. The letter states that, If payment is not done, then they will put a lien on my property. I am a homeowner who hired a contractor to do some work, after the work is complete and I have fully paid the contractor I find out the plumber a sub of the contractor is owed money. That Sub has now filed a lien on my property. Is he allowed to do that even when he knows the prime contractor has been paid?
