I'm seeking assistance and a consultation pertaining to a case I have ongoing. I have an attorney but I feel as if they aren't doing much to help me. The individual in which my complaint is about happens to be a powerful person in my small local area. It seems as if it's impossible to get my attorney to file any actions (complaint, liens, prompt payment etc.). It's been about 12 weeks since this individual breeched contract and haven't been paid our final invoice of over $22,000. That does not include equipment that this individual had me buy to work at his facility which is another $30,000+/-. Lastly which is in my complaint that has been completed 8-9 weeks ago that I paid for that still hasn't been filed is lost work which was promised. We were awarded a project additional to the project were already in the middle of both with an estimated total of over $800,000 (just our share). I have paid my attorney every time she has asked, on the same day every time, totaling over $5,000, which may not seem like much but that's what she has asked for and I haven't had anything filed at all, even though upon several payments she promised to have either the complaint or one of the three liens filed, and she has also promised numerous times that she would get me my overdue invoice right away, which I haven't. She also tells me I cannot add my attorneys fees to said invoice along with that I can't add interest to it either. And while all these delays and mishaps are taking place construction on the project we were performing has completed and the construction on the next project we were awarded is underway. Reducing the effectiveness of the liens I asked to be filed. Do you feel as if I'm being represented correctly?

New YorkMy contract to do work is with an individual, he has since transferred the property to an irrevocable trust with his son as the trustee. Am I able to do a mechanics lien in the Trust Name, and should I include the Grantor and his son The trustee as well?
New YorkLast year I contracted to have some waterproofing done on my house. I gave them a $10,000 deposit and was approved for a loan for the balance. I have postponed the work several times because of the pandemic, I have not gone back to work and my income is Social Security and the unemployment which is due to run out in September. The situation has changed here, not only am I still out of work I've had some health crises that are expensive to treat since insurance doesn't cover it. I want to cancel the contract, I am seriously worried that I won't be able to pay the loan and I could use that money back. The salesman is telling me that if I cancel the contract they can keep my deposit. Is there any way out of this? I have not been called back to work and I probably won't be.

New YorkI had an agreement with a customer too install a vinyl fence for $13,000 with half down $6500 and the remaining $6500 due upon completion of the job. We got the down payment ordered the materials which aren't in yet, and now the guy is demanding his money back and we don't know what too tell him. He wants his money back and thats it nothing more he doesn't want us too do the work he just got impatient, there is no finish by date or anything and we tried too get him too realize that the order isn't in yet he wasn't hearing it and said "thats it im breaching the contract" what do we do about the money he wants back we don't have it as we already paid for the materials.

This client has not paid their invoice. How can I get paid and where should I file the lien?

"A. Escrow Accounts: Any contract payments received by a contractor from a customer prior to substantial
completion of the job must be put into a trust (escrow) account in a bank located in New York State
within five business days and the customer must be informed where the money is being held within ten
business days. The contractor can withdraw the deposit only in the certain circumstances:
B. Alternative Surety Bond: As an alternative to the escrow account, the contractor must deliver to the
customer a "bond" or "contract of indemnity," guaranteeing that the customer’s money will be properly
used or returned. The bond must be delivered within ten business days after the contractor receives the
customer’s money."
I need guidance on how to meet these requirements.
New YorkWe are a floor installation/refinishing company. On March 8th we started job. We had to re-do her floors twice because color was off. We finished the project on 3/13. Client was finally happy with floors - we even buffed/coated her stairs for free for her inconvenience.
We sent client invoice via email from Quickbooks multiple times. We also sent gmails and text messages without a response (approx 5 emails). Also tried to call once. After a few attempts and no response I sent email advising I would have to file a mechanics lien if we did not receive payment. We received a response and was told payment would be sent. This happened on two separate occasions. We have yet to receive payment and want to know if we are past the timeframe in which we can file a lien against their property?
What other recourse do we have?

I have made several complaints to the deleveloper and management company (who are one in the same) about this problem. No one replies and the problem continues. What can I do? Also if the commercial tenant purchases a bond and loses the case on court is the tenant responsible for the entire amount in full.
