Good morning- I am the owner of a property in Santa fe NM where a unlicensed contractor worked on a large (4' x 8') shower renovation project that had a hard deadline of 2/18. The shower has non-functioning defective slope so that neither of the two shower head's water reach the 36" linear drain. It cannot be used and needs corrective work to make functional ( estimated cost is $5100 to redo). I have held back $900 of the final payment to apply to the corrective work ( to be done by a licensed shower tiler). He is threatening to put a mechanics lien on my property for the $900. Can a lien be enforced for defective work that requires significantly more $$ to remedy?

New MexicoI paid a contractor in full for his work although it wasn’t finished and he had some rework he agreed to do in writing. Four days later he sent a letter claiming he was owed more money on work he agreed to do on the original contract. And for supplies. We had already paid $10k which was his full original price and almost the same in materials. And he asked for $8100 more claiming it was for rework which again we never discussed... There was no change order or discussion about his added monies. We refused to pay his outlandish bill. We found out a year and a half later during refi he had put a claim of lien on our property. We were never given notice on the filing Nor was there any legal action taken to enforce the lien. What are our options to get that removed without paying him money for work he never did? We are now 7 days away from closing and will lose our rate lock and potentialLy a mortgage savings of $730 per month if he does not release the lien. We are currently seeking atty support but are there forms we are selves can file to remove them the lien?
New MexicoSo I am a service provider for a company called choice home warranty I performed about 12 service calls for them yeah now I spent up to 700 or more in parts the company owes me at least $1200 according to their prices in and labor cost they provide yet now they are pulling out charges and taking money from me from my overall Mountain Dew for things that are made up that they just saying

We have stipulated a daily calculated 5% late fee based on current amount due. NOT the principal. This has been reminded to the client on each invoice since past due.

New MexicoWhen we complete waiver for our customers, should we include the sales tax in the amount of payment being received? Our company is completing/signing the waiver prior to processing the billings not after the invoices have been billed in our system, so we are unware if they are taxable and if taxable the amount the taxes will be. This would be for Arizona, New Mexico, Utah, Idaho, Texas, California, Nevada, Colorado, Wyoming and Oklahoma - where job are gross receipts or sales tax with no valid tax exemption on file.
New MexicoI was hired to do a tile job but I’m not licensed. I charged 2600.00 and customer agreed and hired me. Job was half way complete when the customer said it wasn’t working out and told me to Leave. Is there anything I can do to collect on the work that was already done. I informed the customer that he owed me money for the work done and he said he would not pay

I’m wondering what happens legally if she were to die during this project. Is there language I can add to my contract to address this?
New MexicoI'm the general contractor on a remodel. Job is complete but customer doesn't want to pay the balance. This the 4th job I have done for this customer with no problems in the past. Always done previous jobs with out a written contracts. This last job is the largest job I've done for them.
Am I better off filing a suit right away and not doing a lien?

New MexicoHi, I am a subcontractor working in NM and was wondering about the Closeout Payment vs retainage in NM. If this the "same" with just different verbiage? I am wondering if I can bill the same as other states but change the wording to Closeout Payment instead of Retainage?

New MexicoThe information above is confusing for New Mexico and the notice requirement. If you are the original contractor (the GC) and you contractor directly with the owner is notice required? Even if the amount claimed is over $5000?
