We have a situation where we paid for a handyman/contractor to do some work for one of our clients at our client's residence. Unfortunately, not long after the work began, we realized that this handyman was not doing a good job, so we stopped working with him and asked him to refund us the down payment we gave him to start the job. He has not given us that money back. So my boss is requesting that we send in a Notice of Intent to File Lien, but I want to be careful to not involve the client who lives at the job site's address, since they are not really a part of this transaction. I'm a member of the Environmental Commission in a NJ township. We developed, and the township committee approved, an ordinance that requires the developers of commercial solar projects to provide a performance bond as described above before they will be issued a construction permit. Our township attorney and the developer's township attorney are now in the process of negotiating a decommissioning agreement for the developer's about-to-be-installed solar array. At lease one party to that negotiation has questioned whether an NJ jurisdiction (the township) can, in fact, require the developer to provide such a performance bond, notwithstanding the ordinance. I had a leaking roof in February from ice daming. A company came out in early March and repaired my roof to the cost of 6200 . Originally the cost was about 2K but the price jumped once he started working on the roof. ( I was away on a business trip at the time.) A few weeks later the same spot that was repaired began to leak, every time it rains the spot drips, I have to keep buckets there. I have reached out to the company several times for him to come make repairs. "I'll come this day" and never shows I have all the proof in text messages. They call me and have me repair their auto shop equipment I also have estimates that were given and ok'd to go forward and order parts and they were never altered afterwards the prices given are the prices they were charged. Also the terms are stated due upon receipt these receipts were signed. I also have emails stating payments are past due and I also have text messages these invoices would be paid. The customer did pay for jobs on one location that his son runs but none of the other shops I did work at were paid. Its amazing this person is in business let alone about 20 locations. I cant believe he has any servicer willing to do work for him.
