Can a mechanics lien be filled for licensed remodel work (a renovated bathroom where the project is complete, for example) where a lending agreement is in place? I did a project back in June and my contract was with the general contractor (CS Builders). The general claimed that the owner did not pay for the second half of the demolition project. The project was paid for by an insurance company the building was damaged during a snow storm. I know we have a lien against the property. Do we also have a lien against CS Builders the corporation? Hello! We worked on the project in NJ, and this project have retainage. In the agreement retainage is paid after 90 days from last delivery. Main order was delivered 11/18/2021, additional order paid by client also delivered11/18/2021. We also supplied remaining items/replacements free of charge on 12/22/2021. Now client is saying that they are still missing few items so they can't release retainage. We calculated our lien due date from last order paid by client 11/18/2021+90=02/16/2022, and we will not be able to deliver missing items till 02/16/2022. Could you please look into this and let us know if we could keep our last delivery date the date, when we deliver last items to complete project free of charge? ...Read More

I was contacted and then issued a PO by the Clifton Public Schools to replace the wall safety padding in School 17 which was damaged by storm Ida. This was an insurance claim filed with their carrier. After the work was completed the school/principal is refusing to pay the PO complaining about they wanted a different type of wall pad, that didn't show the anchors etc. which was more costly and wasn't what was there originally. I did a project for a 2 story commercial building- part of a larger complex of condominiums Have a good written detailed agreement, finished the job, emailed everything, they offered partial payment, I declined, offered to defer a little until permits release, but they have gone silent, so I think I should file a lien.- or a Notice first if necessary. I have filled a mechanics lean against a customer that decided that he wanted the job for free. I filed that lean in 2019 and Levelset did it for me. Obviously, something happened that this customer had his Lawyer contact me saying that his customer is prepared to satisfy the lean and that I should write a satisfaction letter and put it in escrow. So my question is how do you write a satisfaction letter?. Are there form letter that I can make use of? How do you put in a letter in escrow? Additionally, I would like to find out if by law I am allowed to charge the customer the fees that I incurred to create this lean and if I am allowed to calculate and charge interest on the money that is outstanding since 2019. Hi, I filed a Notice of Intent to Lien on 11/24/2021 for a residential project. I understood that I didn't have to send a notice for residential, but I did it anyway. However, it didn't work to get us paid. Now I want to continue with the rest of the Lien process. Residential Arbitration Demand is next, but it has been more than ten days since we filed the Notice of Intent. Since I didn't have to file the notice of intent (I might be mistaken, but info online is confusing about this), I am confused if I can continue with the Residential Arbitration Demand at this point, or is it too late? Hello, There was damage done to my home. A construction company had me sign a contract that allowed him to accept money directly from the Mortgage company. The company took 2 years to due the project and its still not done. In the middle of construction the Mortgage company issued a check with my name and the Contractor's name on it. The Contractor died. His company filed for Chapter 11. What are my rights to get that check endorsed by the Bankruptcy Trustee and given to me to finish my house? It is my understanding that if there is a Mechanic's lien against the property that the money is NOT part of the bankruptcy estate and that the Trustee can simply endorse the check on behalf of the Construction company. What if there is not a mechanic's lien on the property? Does the check become part of the chapter 11 filing, and my insurance money is just mixed in with all of the other Chapter 11 unsecured creditors? Can I at least be given Priority status as a creditor? This is taking place in NJ Bankruptcy Court under chapter 11 . Can I file against his bond company? I read that I might be able to give a 30 day notice to the Construction company to force them to file a mechanics lien, is that true? Any information would be very helpful. ...Read More
