We recently received a letter from a Lawyer regarding two mechanics liens that were rejected over a year ago. The liens were rejected because we were over the "90 day" time frame on both. I presumed since they were rejected that that was the end of it. Should I have done something more to remove these liens off the records? ...Read More

I am a first tier subcontractor on a residential project in NJ. I have a job that was completed 72 days ago. I approached the home owner before the job was completed and explained that her GC was not making payments on the job and she agreed not to pay him the balance and would paid us direct. She did not pay the GC the balance but she did pay other subs to get them to come back to finish the work and now states she has no money left. I notified her via text of our intent to file immediately upon completion of the project and she said that she would pay but has been giving me the run around. I did not file the NOI because of her making false promises to pay. Can I still file a lien if my notice of intent is after 60 days and the home owner has paid other subs. (Not the GC directly)...Read More

My contractor amended the contract to include an addendum; After he breached the original contract. The end date in the addendum was September 13. He still has not completed the work fully, although minor finishing touches, he is requesting the full amount due to him which is 4.5K. How do i go about telling him i disagree and that i want to be compensated for the lost productivity and rent i’ve paid while not being able to operate the business?...Read More

I'm a general contractor and I finished a job for a medical office space early September 2020. Due to the pandemic and the doctor just opening his business, I told him he could pay me by October 30, 2020, which was just under 2 months after the work was completed. He proceeded to tell me that he was selling a machine and then was opening a credit card and that he would pay me but just needed a little more time. By December he said business was really slow and he didn't get the credit card approval, and then had to sell his house. He assured me that he would pay as soon as his house sold, but that happened in February and now he said he needs another month. I didn't know about filing a construction lien and the time frame before, but I am hoping there are extensions due to COVID-19....Read More

We seemed to misunderstand how long we had to file a lien, a rep at Levelset says it wont go through prior to April 10th in Monmouth County NJ if we do this now. We need to see what other course of action we have or can take on a very large commercial job that we started on Christmas 2022 and completed on 4/10/23. The amount due was $508,127.25 and we have been paid less than half, and are still owed a balance $282,497.25 This is a commercial water mitigation that is an insurance loss at a school which is rented from a church....Read More

I am a subcontractor on a housing authority project and the GC won't provide the remaining amount of the subcontract. He has directed me to talk to his attorney and doesn't believe he owes me any money. He also has not submitted or negotiated any change orders on the project that were identified as unforeseen conditions and winter conditions. What are the steps and restrictions in filing the mechanics lien? Can I include the change orders that were submitted and remain outstanding? The work for those are complete....Read More

I worked on a project for a GC with a subcontract agreement to subtract actual payroll costs from the subcontract during the progress of the work. The GC wrote in the subcontract that I would be compensated the remaining delta. They provided the materials. I provided the field sampling and laboratory testing via 3rd Party. The GC is unwilling to submit a significant change order for the benefit of the subcontractor due to his relationship with the owner. The outstanding change orders for unforeseen conditions, winter concrete protection, and filling voids in substrate exceed $50,000. The remaining balance of the subcontract also exceeds $50,000. My company designs and supplies equipment to contractors. The first thing we do after receiving an order is generate an engineering submittal, which can take up to 6 weeks of labor. Then the customer approves it, or asks for corrections before approving it. This approval is our first billing milestone. So when setting a "Date Labor or Materials Last Delivered" in zlien, do I use the date on which we begin expending labor? Or do I use the date that submittals are approved, which is the date where the customer believes they've actually had something 'delivered' to them?
