It was a painting job in which I was fired from because they somehow got into my Sherwin Williams account and found out how much I was actually paying for paint and thought I was ripping them off. There was also an issue of how much work I completed and I obviously couldn’t get all the after photos so the ones I do have, they sent in before pictures and claimed it was shoddy work. There’s a lot more to it. I sent in a motion to reconsider but was denied because it looked like I was trying to send in new exhibits when they were just copy’s of the documents I wanted the judge to look over again because I believe there were things he overlooked. Time is of the essence, I want to appeal it to the Supreme Court but I think I need a legal reason. ...Read More

We were contracted by the future owners of a sandwich shop to fit-up retail space they planned to lease. Nothing in the contract listed the landlords company name, nor were they ever invoiced for any work. The project went very well and we were paid in full and ultimately our subs were paid in full. My client has received a lien release. But since our clients are to be reimbursed for the restroom construction, the landlord wants a lien release. I don't feel obligated to provide one. It seems like I'd be falsifying a legal document since I never was contracted by them. Am I wrong?...Read More

My aunt and uncle purchased a house in Lancaster, NH to renovate, with the intent to rent it out as an airbnb. They are new to the area, and had some bad luck with handiman type guys. So, they asked for my help. I live about an hour away in Vermont, but I am a kitchen and bath designer and I regularly manage full construction projects. I did not have any contractor contacts in that area, so I made the mistake of finding someone on Facebook. We signed a boilerplate contract that spelled out what the work load was, for $13k, approx 4 weeks or 160 hours of work for two men. I asked for his insurance, which he provided. Once the contract was signed, we assumed he would start right away, as he said he hadn't booked any work over the winter to be home with his kids who are remote schooling. But it was almost a week before he started. And then his appearances at the house were spotty at best. There have been other guys that showed up to do some work, but nothing consistent. He also asked for $3300 for materials, which I wrote a check for, and asked for the receipts. We also gave him an additional $1000 for a "change order" to rebuild the interior stairs. That was a verbal communication. After more than four weeks, we are not even halfway done, and I have had to postpone the flooring contractor, and a few other things as well. We made the decision to just cut ties with him. We made arrangements for him to meet at the house on Monday at 9am so that it could all be discussed civilly and he could gather his tools. Well, he showed up at 7:45 and saw that the house was locked, and the lock box was removed, and left. And since then he has been threatening to me that he will take us to court for breach of contract, etc. Yesterday he was allowed to come and take all of his tools. To date, we paid a $7000 deposit on the original Proposal of $13k. I have given him $3300, and $1000 for materials. He refuses to produce any receipts and says he is owed another $3000 for labor to date. And that he will take me to court, because I was the one that signed the proposal. I just want to get a sense of whether it is worth fighting this in court, as I have documentation of all conversations, etc, and I feel that I am in the right. Or should I just pay him and get it out of my life? ...Read More

Hello my name is Jim Brown and I'm a sole proprietor for J&D floor covering in RI. I was asked by a Massachusetts construction company to install flooring at a jobsite in NH. I was coaxed basically from 1 dollar a sf up to 2 dollars a sf which I finally said yes. Starting on October 8th I started installing and finished 8 days later. I then sent an invoice for 4284.00. This was a second invoice the first one I was asked to lower because it had additional monies in it because of extra work like floor prep. It would have been 1000 higher which I finally agreed too. I finally received a check for 2658. I asked why not full payment and was told its policy to withhold till final inspection. I waited until 90 days passed asked when I can expect to receive balance and was told today. They kept 486 for workman's comp insurance and 1140 to repair some door jambs in a unit. For one thing I've worked for this group in the past and never had to pay for this insurance and I was never given the chance to go and repair any issue with the floor, The amount they are charging for a small repair is extravagant. I want to know if I can file a lien for the remainder? Thanks Jim...Read More

hi, we gave our contractor 50% of our house project's total cost. We just found out that although his crew has been working on the house with the materials that have been delivered, he never ordered the remaining materials to complete the job and also owes the lumber yard for the windows and siding that were delivered. We want to cut ties with the contractor as soon as possible. What is the safest document for us to use so he cant come back and say we owe him more? We will settle up with the lumber yard directly and they will give us a balance paid receipt. Thank you ...Read More

My boyfriend has been living with me for over 3 years. We got in fight and he threatened me with contractors/mechanics lien. He has done a lot of work in house, outbuildings and property. However has done so with on site materials and donated material. Walls, electric, etc.. are not up to code. He has also ran 2 trucks and 1 car. Into the ground. I haven't paid him money..but have provided room, meals and cigarettes to him for 3 years. Just wondering if it is even a possibility that he could do this?...Read More
