I paid Rebath half of the $15k total for my bathroom remodeling project. ($7,500) they've not done any of the work. Still waiting for the rest of my materials. They now say they are going bankrupt and I can either wait "a month or two until they're able to get to my project" or come get my materials they've ordered and have somebody else finish the project or wait until they file and my account will be included in the bankruptcy. Do lien waivers still hold value or are they null if the Preliminary Notice was not sent to the General Contractor? We are a subcontractor working with a GC, and we failed to deliver a preliminary notice. I have been threatened by ERX to have a mechanics placed if I do not pay the full amount charged for water mitigation/remediation done in my house. ERX stated through a voicemail (which I have) that they would accept what my insurance company provided (which is approx. $800 less than what they billed). I promptly paid ERX the full amount of what my insurance provided when I received the ERX bill, plus worked with my insurance company to negotiate an additional amount to be given by ERX after review of work that ERX provided. That still leaves about $800 unpaid. I have not heard whether ERX is going to proceed with a mechanics lien for the last $800. My question is whether I can/should ask ERX to provide me with an unconditional release from any of claim of mechanics lien since I am not going to use them for the restoration portion of my claim and they have cashed both checks I sent to them for the mitigation/remediation portion of the claim. I just received an NOI from a handyman we hired. He quoted us a price of $200 and said it would take him a day to a day and a half to finish. On the third day, work was still not done! At that time, we gave him $100 (I have a signed receipt from him) and told him we would give him the $100 balance when the work was completed. On day 4, he got agitated about something, startine swearing and throwing his tools., He then walked out! I have pictures of the mess he left behind and the unfinished work. We had to hire someone else to come in and finish the job and correct all the mistakes he made. That cost us $300! The first handyman sent the NOI, stated we owe him $200.
