I did my mechanics lein, it was placed on the property but the homeowner abandoned the house, and moved out of state. The granddaughter is the trustee on the home and offered the home as payment, what do I do? Payments still have not been paid and the house is just sitting. Do I have the right to obtain possession? And file this with the state accessors? And legally own this home, ? Or can the granddaughter just pull a loan to pay the debt. Her credit is shot and is in a bad place and I need some answers to help me get this behind me and move forward...Read More

We have been operating as a mitigation business for 13 years without a contractors license that was approved and verified over the years by the contractors board here in Nevada. This was approved because we only did light demo, removed cabinets, and placed drying equipment at properties. This is all done by employees. No subcontractors are every involved. This year, 2023, here in Nevada the contractors board changed the requirements and we now have to have a contractors license. My questions is in 2022 (before the change) we did mitigation work on a property and they refused to pay us even though their homeowners insurance approved our bill and paid him to pay us. This homeowner is the one who made the complaint to the contractors board at the end of 2022 that made the contractors board change the rules. The contractors board let us know that even though they were putting a stop to our ability to operate with a contractors license that the homeowner still would need to pay us for the work that we did. Of course the homeowner did not, so we went through the proper motions and now have a full mechanics lien on the property. We are now going to small claims court and the lawyer the owner is using is suggesting that we release the lien since we did not have proper license to do the work. Should we release this lien?...Read More

We offer two services and are currently operating under one contractor company/license. We provide mitigation services with a contract and then we provide the reconstruction services with a different contract. Even though we use two different contracts, since we are operating under the same company, can we use the last time we were providing a service at the property for the lien? For example.. We provide mitigation services at 123 Smith St Las Vegas, NV 89123 and we complete the job on 3/10/2023. Then we begin the reconstruction service and finish on 5/10/2023. Can we use the last time we provided materials/service for the mitigation work on 5/10/2023 since it is the same property and we are the same company?...Read More
