I performed work as a laborer for a homeowner who owns three personal properties. The work consisted of painting the interior and exterior of the homes and property management which consisted of lawn mowing, minor repairs, etc. while the homeowner was out of town for 4 months. I began doing this work approximately 2 years ago, and obtained a written agreement from the homeowner that I would do all the labor on is properties at a heavily discounted rate. The discounted rate was agreed to because the agreement called for me profiting from the eventual sales of the properties. The amount owed to me for property management fees are approximately $3,900.00 and the approximate profit coming to me from the eventual sales of the three properties is between $50,000 to $60,000. The homeowner is now telling me that he will not honor the original written agreement and is refusing to pay me the property management fees and will not pay me my share of the profit upon the sale of the three properties. ...Read More

I recently got a letter notifying me that there was a construction lien on our house. The letter was through the NE Register of Deeds. The issue is our contractor stopped showing up, so we fired him and had someone else do the job. 130 days later he filed this lien. He lied on the letter about the last date he worked so that it would still appear as if he was within the 120 day window. (I have everything documented in writing). He also lied about the contract amount. I have read that I need to send him a demand letter that he needs to initiate judicial proceedings. Is that accurate? After I do that, how do I go about getting the lien removed because I don't think he will file the paperwork to remove it. Thank you!...Read More

Hello and thank you for participating in this forum. On Thursday, April 15 I gave a cash deposit to the significant other of a friend of mine that is wanting to get his construction business off the ground. The job description was to tear off the one layer of shingles on my 960 sq ft, 111 yr old little bungalow house and very small garage. He scratched a few numbers making calculations on a notebook I lent him. He didn't have any business like forms. He came up with numbers that I didn't realize were way off to the tune of he quoted me $4,300 for labor only for my little roof with 17.65 squares. I was buying the materials myself. I gave him the $2,500 deposit. No contract was signed or even discussed. On Monday April 19th I texted him asking for a receipt for the the $2,500 deposit. He responded "yup". He said he would write one up. No denying that the transaction had occurred or denying that it had been for that amount. He never has given me any kind of a receipt for the deposit. It's very frustrating as he isn't very responsive to calls or texts. I received a call from Menards on Sunday April 25th in the afternoon telling me that they were out of stock of some of the items in my order of roofing supplies. They won't have any arriving for at least 18 days as the warehouse is out of stock until they can get a shipment from their wholesaler. I texted the contractor immediately. He replied "ok". So now the job is postponed indefinitely. Today, Tuesday April 27th, I found out that while i was at work over the weekend my parents had had the "roofing guy" that they've used for their rental properties for the last 25 years come by my place to get an estimate for them from him on my reshingle the rooves job. It was much lower than the verbal estimate I'd been given. The estimate I'd been told was $4,300 for just labor. No materials of any kind. No dumpster. Just labor. The estimate that my parents contractor worked up came to $4,976. That figure includes tear off of the shingles on both the house and garage, and the dumpster to put it all in. That's already more value than what my estimate quoted. Their estimate also included all the materials and labor for all new gutters for both the house and the garage. Less than $700 difference for so much more value. And I strongly suspect much higher quality craftsmanship also. My parents know that my pockets aren't very deep. They feel at this point in their lives they want to do some good with their money for their kids. They said that they would pay for the roof job but only if I used their contactor. I feel like I don't really have any choice here. The job, if using the first contractor, has been suspended indefinitely through no fault of my own. The second guy has a much bigger crew than the first guy so he'll be able to get it all done in one day as opposed to 4-5 days with the first contractor. Since it's such a small job, the second contractor said he could squeeze me in almost immediately. I called the first contractor today but he didn't answer. I sent him a lengthy text explaining the situation that my parents have put me in and that I need my deposit back since he won't be doing my roof. I think that he doesn't know that deposit monies need to be put in an escrow account until its time to pay out. I apologize for length of this. What do I do? How can I get my money back? We fired our contractor after he lied about replacing/reconnecting the duct from the hot water heater. He told us he had completed this after many requests to do so, and it turns out he did not, leaving it open below and above the shower he was working on. We have since had an HVAC professional and plumber tell us how dangerous this is. He had also failed to fix a leaking shower valve over the course of a week though we told him each time the valve was leaking from the second floor bathroom into the first floor ceiling and each time he claimed to have fixed the leak. At one point he had it duct taped. He lied about ducting the exhaust fan above the shower, instead leaving it unvented above the shower. He was almost finished with the job, though once we realized he had lied and put our family in danger with the hot water heater duct open, we did not feel safe having him complete the work. We now have had a licensed plumber (the original contractor claimed he is licensed but the city does not have any trade licenses in his name) in who has described multiple errors. The initial contractor is demanding payment; we have told him we are needing to have the entire project redone due to the errors he has made and the shoddy workmanship. Once that is completed, we will pay him for the work he actually completed according to the contract, but not for the work he did incorrectly. Can I file a lien when a client agreed and signed invoice that states payment terms. $100booking deposit , remaining half down at the end of the first. And balance due upon completion. He paid the booking. And gave a check for the remaining half down on day 2. . Which was a Sunday and I couldn't cash it. .I asked for the check at the end of day 1 like contract states. I live in Omaha, NE and a roofing company installed a roof on my house incorrectly, they also did not finish the job and refused to finish the job. They kept demanding payment and never provided an itemized bill which was asked for 3 times. When we finally did receive a bill it had charges for work and material that were never provided. Since then we have received confirmation from the engineers at company from the products used was installed incorrectly and would have to be fixed(it is a major issue that would require removing about 1/3rd of the shingles from the bottom and fixing the issue.) The owner said that he would put a lien on my property and would not respond to us asking for him to finish the job. We recently received notice that he was putting a lien on our house but the date of time services or materials were furnished was incorrect on the filing. What can/should we do?...Read More
